DEAR SENATOR: Receipt is acknowledged of your letter of February 22, transmitting a copy of a bill (S. 3621) with request that the committee be furnished with such suggestions touching its merits and the propriety of its passage as the department might deem appropriate.

This bill would authorize the Secretary of War whenever he shall approve plans for a bridge authorized by law to be built across the Louisiana and Texas Intracoastal Waterway to grant to the person or corporation, municipal or private, building such bridge the necessary right of way therefor across lands of the United States on either side of and adjacent to said waterway, such authority to be exercised in the discretion of the Secretary of War and under such terms as he may deem equitable, expedient, and just to the public. The bill is without objection so far as this department is concerned.

The Committee on Interstate and Foreign Commerce, to whom was referred the bill (S. 3745) to extend the times for commencing and completing the construction of a bridge across the Cumberland River at or near Smi hland, Ky., having considered the same, report thereon with a recommendation that it pass.

The acts of Congress referred to in the bill are as follows:

AN ACT Authorizing the State highway commission, Commonwealth of Kentucky, to construct, maintain, and operate a bridge across the Cumberland River at or near Smithland, Kentucky Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the consent of Congress is hereby granted to the State highway commission, Commonwealth of Kentucky, to construct, maintain, and operate a bridge and approaches thereto across the Cumberland River, at a point suitable to the interests of navigation, at or near the city of Smithland, Kentucky, in accordance with the provisions of an act entitled "An act to regulate the construction of bridges over navigable waters," approved March 23, 1906, and subject to the conditions and limitations contained in this

act.

SEC. 2. If tolls are charged for the use of such bridge, the rates of toll shall be so adjusted as to provide a fund sufficient to pay the reasonable cost of maintaining, repairing, and operating the bridge and its approaches under economical management, and to provide a sinking fund sufficient to amortize the cost of the bridge and its approaches, including reasonable interest and financing cost, as soon as possible under reasonable charges, but within a period of not to exceed twenty years from the completion thereof. After a sinking fund sufficient for such amortization shall have been so provided, such bridge shall thereafter be maintained and operated free of tolls, or the rates of toll shall thereafter be so adjusted as to provide a fund of not to exceed the amount necessary for the proper maintenance, repair, and operation of the bridge and its approaches under economical management. An accurate record of the costs of the bridge and its

approaches, the expenditures for maintaining, repairing, and operating the same, and of the daily tolls collected, shall be kept and shall be available for the information of all persons interested.

SEC. 3. The right to alter, amend, or repeal this act is hereby expressly reserved.

AN ACT To extend the times for commencing and completing the construction of a bridge across the Cumberland River at or near Smithland, Kentucky

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the times for commencing and completing the construction of the bridge across the Cumberland River, at or near Smithland, Kentucky, authorized to be built by the State highway commission, Commonwealth of Kentucky, by the act of Congress approved May 18, 1928, are hereby extended one and three years, respectively, from May 18, 1929. SEC. 2. The right to alter, amend, or repeal this act is hereby expressly reserved.

Approved, March 2, 1929.

The bill has the approval of the War and Agriculture Departments, as will appear by the letters attached and which are made a part of this report.

This bill would extend for one and three years, respectively, from the date of its approval, the times for commencing and completing the construction of the bridge across the Cumberland River at or near Smithland, Ky., authorized by act of Congress approved May 18, 1928, to be built by the State Highway Com mission of Kentucky. Favorable action on the bill is recommended.
