R. 9141] The Committee on Interstate and Foreign Commerce, to whom was referred the bill (H. R. 9141) to authorize the State Roads Commission of Maryland to construct a highway bridge across the Nanticoke River at Vienna in Dorchester County to a point in Wicomico County, having considered the same, report thereon with amendments, and, as so amended, recommend that it pass. Amend the bill as follows: Strike out all after the enacting clause and insert the following in lieu thereof: That the consent of Congress is hereby granted to the State Roads Commission of Maryland to construct, maintain, and operate a free highway bridge and approaches thereto across the Nanticoke River, at a point suitable to the interests of navigation, at Vienna in Dorchester County, Maryland, in accordance with the provisions of the act entitled "An act to regulate the construction of bridges over navigable waters," approved March 23, 1906. SEC. 2. The right to alter, amend, or repeal this act is hereby expressly reserved. Amend the title so as to read: A bill granting the consent of Congress to the State Roads Commission of Maryland to construct, maintain, and operate a free highway bridge across the Nanticoke River at Vienna, Dorchester County, Maryland. R. 9180] The Committee on Interstate and Foreign Commerce, to whom was referred the bill (H. R. 9180) granting the consent of Congress to the North Carolina State Highway Commission to construct, maintain, and operate a free highway bridge across the Roanoke River at or near Weldon, N. C., having considered the same, report thereon with amendments and as so amended recommend that it pass. Amend the bill as follows: Strike out all after the enacting clause and insert the following in lieu thereof: That the bridge now being constructed across the Roanoke River at Weldon, North Carolina, by the State of North Carolina, if completed in accordance with plans accepted by the Chief of Engineers and the Secretary of War, as providing suitable facilities for navigation and operated as a free bridge, shall be a lawful structure, and shall be subject to the conditions and limitations of the Act entitled "An act to regulate the construction of bridges over navigable waters," approved March 23, 1906, other than those requiring the approval of plans by the Secretary of War and the Chief of Engineers before construction is commenced. R. 9180, 71st Cong., 2d sess.) proposes to authorize the building of a bridge across the Roanoke River at Weldon, N. C., by the State of North Carolina. HR-71-2-VOL 2-19 Under date of November 8, 1929, the State of North Carolina made application to this department for approval of plans for the construction of the bridge referred to in the above-mentioned bill, but in view of the fact that such work was not authorized by Congress as required by section 9 of the river and harbor act of March 3, 1899, the department was without authority to approve the plans thereof. However, the State of North Carolina was notified that no objection would be interposed by this department to the proposed construction in accordance with the plans submitted, but an act of Congress should be obtained to legalize the structure. Accordingly, the bill has been amended to harmonize with the facts cited above, and as thus amended I know of no objection to its favorable consideration. PATRICK J. HURLEY, Secretary of War. Hon.
