paid according to the laws of such State, and the proceedings therefor shall be the same as in the condemnation or expropriation of property for public purposes in such State.

SEC 3. The said Los Olmos International Bridge Company, its successors and assigns, is hereby authorized to fix and charge tolls for transit over such bridge in accordance with any laws of Texas applicable thereto, and the rates of toll so fixed shall be the legal rates until changed by the Secretary of War under the authority contained in the act of March 23, 1906.

SEC. 4. The right to sell, assign, transfer, and mortgage all the rights, powers, and privileges conferred by this act is hereby granted to the Los Olmos International Bridge Company, its successors and assigns, and any corporation to which or any person to whom such rights, powers, and privileges may be sold, assigned, or transferred, or who shall acquire the same by mortgage foreclosure or otherwise, is hereby authorized and empowered to exercise the same as fully as though conferred herein directly upon such corporation or person.

SEC. 5. The right to alter, amend, or repeal this act is hereby expressly reserved. Approved, May 28, 1928.

The bill as amended has the approval of the State and War Departments, as will appear by the letters attached and which are made a part of this report.

So far as the interests committed to this department are concerned, I know of no objection to the favorable consideration of the accompany bill (H. R. 5622, 71st Cong., 2d sess.) to extend the time for the construction of the bridge across the Rio Grande at or near Weslaco, Tex.

However, attention is invited to an act (S. 1909, 71st Cong., 2d sess.) which proposes to extend the times for commencing and completing construction of the above-mentioned bridge. A favorable report on this act was submitted to the President under date of December 17, 1929. It appears, therefore, that if the President has approved S. 1909, the passage of the accompany bill is

DEAR MR. PARKER: Careful consideration has been given to the bill (H. R. 5622) transmitted with your letter of January 8, with request for a report thereon and such views relative thereto as the department might desire to communicate. This bill would extend for one and three years, respectively, from the date of its approval the times for commencing and completing the construction of a bridge authorized by act of Congress approved May 28, 1928, to be built by the Los Olmos International Bridge Co. across the Rio Grande River at or near

Weslaco, Tex. A route on the system of Federal-aid highways approved for Texas parallels the river and passes through the town of Weslaco.

When the original bill to authorize the construction of this bridge was pending in Congress this department was asked for a report thereon and advised that since the proposed structure would be an international bridge no objection would be interposed to the passage of the bill. At the annual convention of the American Association of State Highway Officials at San Antonio, Tex., last November, there was present a delegation of highway officials from the Republic of Mexico, and the question of bridges across the Rio Grande was considered and discussed at length with these Mexican officials. The result was that the convention of the American Association of State Highway Officials passed the following resolution:

"Whereas the international travel between the United States and Republic of Mexico has increased to the extent that plans must be made for the construction of free international bridges, or provision made for providing crossings of streams; and

"Whereas the Republic of Mexico is entering upon an extensive road-building program, many cardinal routes of which extend to the international border; and 'Whereas representatives of the Mexican Government have been present at the meetings of this association and have participated in the discussions with regard to international bridges and have indicated their approval and assent to the following resolutions: Therefore, be it

"Resolved, That the American Association of State Highway Officials request of the Congress of the United States that no further permits be granted to private interests for the erection of toll bridges across the Rio Grande River and that a similar request be made of the Mexican Government, through the highway commissioner or representative of that Republic, it being the purpose of this resolution to provide, if necessary, for the construction of toll bridges between respective Governments, said bridges to become free to the public when they shall have been paid for by tolls."

In view of the foregoing the department would recommend against favorable action on the bill.

REPORT

[To accompany H. R. 6843]

The Committee on Interstate and Foreign Commerce, to whom was referred the bill (H. R. 6843) to grant the consent of Congress to the Highway Department of the State of Tennessee to maintain a bridge across the Hatchie River on the Bolivar-Selmer Road about 30 miles southeast of Bolivar and a short distance upstream from the mouth of the Piney Creek, in Hardeman County, Tenn., having considered the same, report thereon with amendments and as so amended recommend that it pass.

Amend the bill as follows:

Page 1, line 5, after the word "operate" insert the following "in accordance with the provisions of the act entitled 'An act to regulate the construction of bridges over navigable waters,' approved March 23, 1906." Line 6, strike out the word "originally" and insert the word "already" in lieu thereof.

Page 2, line 4, strike out the words "without the prior approval of plans and location." Strike out all of lines 5, 6, 7, and 8, and insert the following in lieu thereof: "which bridge is hereby declared to be a lawful structure to the same extent and in the same manner as if it had been constructed in accordance with the provisions of said act of of March 23, 1906."

The bill as amended has the approval of the War and Agriculture Departments, as will appear by the letters attached and which are. made a part of this report.

This bill would authorize the Tennessee Highway Department, its successors and assigns, to maintain and operate the bridge and approaches thereto already constructed by said department across the Hatchie River on Bolivar-Selmer Road about 3.9 miles southeast of Bolivar and a short distance upstream from the mouth of Piney Creek in Hardeman County, Tenn., without prior approval of plans and location by the Chief of Engineers and the Secretary of War. The bridge in question is located on the system of Federal-aid highways approved for Tennessee. The bill is without objection so far as this department is con

cerned.
