EXTENDING THE TIME FOR ENROLLMENT OF THE INDIANS OF CALIFORNIA

Mr. WATKINS, from the Committee on Interior and Insular Affairs, submitted the following

REPORT

[To accompany H. R. 2974]

The Committee on Interior and Insular Affairs, to whom was referred the bill (H. R. 2974) providing for the extension of the time for enrollment of the Indians of California, having considered the same, report thereon with the recommendation that it do pass, with the following amendments:

On page 1, line 9, strike out the period and add the following: and by inserting after the third sentence "For the purposes of clause (d) of this section, when the Secretary of the Interior is satisfied that reasonable and diligent efforts have been made to locate a person whose name is on said roll and that such person cannot be located, he may presume that such person died prior to the date of approval of this Act, and his presumption shall be conclusive".

On page 2, line 3, after the comma, insert the following:

as amended by the Act of April 29, 1930 (46 Stat. 259),

This bill has been considered by the Committee on Interior and Insular Affairs of the House of Representatives. On February 23, 1954, that committee submitted its report (H. Rept. No. 1219) recommending its passage, and on March 15, 1954, it passed the House.

EXPLANATION OF PROPOSED AMENDMENTS

The present statute directs the Secretary to remove from the 1933 roll the names of any persons who died between May 18, 1928, and May 24, 1950.

The present statute also directs the Secretary to make a $150 per capita payment to each enrollee who was living on May 24, 1950. The Secretary has been unable to determine whether some of the persons listed on the 1933 roll were alive on May 24, 1950, or whether
