Mr. LEA, from the Committee on Interstate and Foreign Commerce, submitted the following

REPORT

[To accompany S. 3282]

The Committee on Interstate and Foreign Commerce, to whom was referred the bill (S. 3282) to extend the times for commencing and completing the construction of a bridge across the Bay of San Francisco from the Rincon Hill district in San Francisco by way of Goat Island to Oakland, having considered and amended the same, report thereon with a recommendation that it pass.

Amend the bill as follows:

Page 1, line 10, after the words "two and" strike out the word "seven" and insert the word "five" in lieu thereof.

The bill has the approval of the War, Navy, and Agriculture Departments, on H. R. 8021, a similar bill, as will appear by the letters attached.

So far as the interests committed to this department are concerned, I know of no objection to the favorable consideration of the accompanying bill (H. R. 8021, 72d Cong., 1st sess.) to extend the times for commencing and completing the construction of a bridge across the Bay of San Francisco from the Rincon Hill district in San Francisco by way of Goat Island to Oakland.

MY DEAR MR. CHAIRMAN: Replying further to the committee's letter of January 21, 1932, submitting the bill (H. R. 8021) to extend the times for commencing and completing the construction of a bridge across the Bay of San Fran

cisco from the Rincon Hill district in San Francisco by way of Goat Island to Oakland, and requesting report and recommendation thereon, I have the honor to inform the committee as follows:

The purpose of this bill is to extend the times for commencing and completing construction of this bridge two and seven years, respectively, from February 20, 1932. Postponing commencement for two years will not materially affect the interests of the Navy. However, postponing the period for completion for seven years is believed somewhat longer than should be required. It is estimated that the work involved will require at least three years of actual construction operations.

The Navy Department foresees no disadvantage to Navy interests in postponing the times for commencing and completing the construction of the bridge as provided in the bill H. R. 8021, and therefore recommends its enactment. Sincerely yours,

DEAR MR. RAYBURN: Careful consideration has been given to the bill (H. R. 8021) transmitted with your letter of January 20 with request for a report thereon and such views relative thereto as the department might desire to communicate. This bill would extend for two and seven years, respectively, from February 20, 1932, the times for commencing and completing the construction of a bridge across the Bay of San Francisco, at or near the general site from Rincon Hill, in the city and county of San Francisco, to and across Goat Island, in San Francisco Bay, thence to Oakland, county of Alameda, authorized by act of Congress approved February 20, 1931, to be built by the State of California. Favorable action on the bill is recommended.

AN ACT Granting the consent of Congress to the State of California to construct, maintain, and operate a bridge across the Bay of San Francisco from the Rincon Hill district in San Francisco by way of Goat Island to Oakland

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the consent of Congress is hereby granted to the State of California to construct, maintain, and operate a bridge and approaches thereto across the Bay of San Francisco, at a point_suitable to the interests of navigation, at or near the general site from Rincon Hill, in the city and county of San Francisco, to and across Goat Island, in San Francisco Bay, thence to Oakland, in the county of Alameda, in accordance with the provisions of an act entitled "An act to regulate the construction of bridges over navigable waters," approved March 23, 1906, and subject to the conditions and limitations contained in this act: Provided, That permission for such bridge to cross the Government reservation on Goat Island shall first be obtained from the Secretaries of War, Navy, and Commerce: Provided further, That if any buildings, improvements, or facilities on such Government reservations are damaged or destroyed by the construction of said bridge they shall be repaired or replaced by the State of California on a site or sites acceptable to the respective head of the department having jurisdiction over the property involved.

SEC. 2. If tolls are charged for the use of such bridge, the rates of toll shall be so adjusted as to provide a fund sufficient to pay the reasonable cost of maintaining, repairing, and operating the bridge and its approaches under economical management, and to provide a sinking fund sufficient to amortize the cost of the bridge and its approches, including reasonable interest and financing cost, as soon as possible under reasonable charges, but within a period of not to exceed

forty years from the completion thereof. After a sinking fund sufficient for such amortization shall have been so provided, such bridge shall thereafter be maintained and operated free of tolls or the rates of toll shall thereafter be so adjusted as to provide a fund of not to exceed the amount necessary for the proper maintenance, repair, and operation of the bridge and its approaches under economical management. An accurate record of the costs of the bridge and its approaches, the expenditures for maintaining, repairing, and operating the same, and of the daily tolls collected, shall be kept and shall be available for the information of all persons interested.

SEC. 3. The right to alter, amend, or repeal this act is hereby expressly reserved, and the United States shall incur no liability of any kind whatsoever for the alteration, amendment, or repeal thereof.
