R. S. 4342. The owners of vessels residing on New River, in Onslow County, in the State of North Carolina, shall have the privilege of taking out registers or enrollments and licenses at Wilmington, in that State, and the collector of that district may grant the same on the conditions required by law.

R. S. 4343. The deputy collector who may be appointed to reside at Chesapeake City, in Maryland, shall have power to grant enrollments and licenses to vessels.

R. S. 4344. The Secretary of the Treasury may authorize the surveyor of any port of delivery, under such regulations as he shall deem necessary, to enroll and license vessels to be employed in the coasting trade and fisheries, in like manner as collectors of ports of entry are authorized to do.

R. S. 4345. The surveyors appointed for the ports of Cold Spring, on the north side of Long Island, Greenport, and Port Jefferson, all in the State of New York, shall have power to enroll and license vessels to be employed in the coasting trade and fisheries, and to enter and clear, and grant registers and other usual papers to vessels employed in the whale fisheries, under such restrictions and regulations as the Secretary of the Treasury may deem necessary.

R. S. 4371. Every vessel of twenty tons or upward, other than registered vessels found trading between district and district, or between different places in the same district, or carrying on the fishery without being enrolled and licensed, or if less than twenty tons and not less than five tons, without a license, in the manner provided by this title, if laden with merchandise the growth or manufacture of the United States only, distilled spirits excepted. or in ballast, shall pay the same fees and tonnage in every port of the United States at which she may arrive as vessels not belonging to a citizen of the United States; and, if she have on board any articles of foreign growth or manufacture, or distilled spirits, other than sea stores, she shall, together with her tackle, apparel, and furniture, and the lading found on board, be forfeited. MY DEAR CONGRESSMAN: In your bill, H. R. 7383, Seventy-first Congress, second session, it is noted that you do not include in the statutes to be repealed the following numbered sections of the Revised Statutes and the Statutes at Large:

R. S. 4334, which is reproduced as section 287, title 46, of the code, is obsolete. These sections and parts of sections are either obsolete or nugatory and are referred to in Supplement 3 of the Code of the Laws of the United States, and it will be of considerable advantage if they can be incorporated in your bill and thus definitely removed from the statutes.

GENTLEMEN: I have your letter of December 11, 1931, inclosing copy of a letter dated December 9, 1931, from the legislative reference service of the Library of Congress concerning sections 4316, 4317, 4371 R. S., reported upon by my letter of July 6, 1931.

As requested by you, further comments upon these sections follow: 4316 R. S.: It is the view of this department that this section, in so far as it relates to the transportation of merchandise, was superseded by section 27 of the merchant marine act, and, in so far as it relates to the transportation of passengers, was superseded by the act of June 19, 1886 (24 Stat. 81), as amended by the act of February 17, 1898 (30 Stat. 248; U. S. C., title 46, sec. 289).

4317 R. S.: The above comments apply to this section also.

4371 R. S.: Inasmuch as this section applies only to vessels which are entitled to be documented (see Op. At. Gen. dated November 20, 1912: 29 Op. At. Gen. 574), and the act of June 19, 1886 (24 Stat. 81), section 7, repeals all that part of the section that applies to such vessels, the act of June 19, 1886, must be regarded as a complete repeal of section 4371 R. S.

The Committee on the Library, having had under consideration S. J. Res. 75, reports the same with recommendation that it do pass. At the Executive Mansion, there is a portrait in oil of each of the Presidents up to the incumbency of Ex-President Coolidge. This resolution is in the usual form for the usual amount and directs the Joint Committee on the Library to carry it into execution. This is also the usual and customary method.
