An Act

To permit black and white or color reproductions of United States and foreign postage stamps under certain circumstances, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That paragraph (1) of section 504 of title 18, United States Code, is amended to read as follows:

"(1) the printing, publishing, or importation, or the making Reproductions. or importation of the necessary plates for such printing or publishing, of illustrations of—

"(A) postage stamps of the United States,

(B) revenue stamps of the United States,

(C) any other obligation or other security of the United States, and

"(D) postage stamps, revenue stamps, notes, bonds, and any other obligation or other security of any foreign government, bank, or corporation,

for philatelic, numismatic, educational, historical, or newsworthy purposes in articles, books, journals, newspapers, or albums (but not for advertising purposes, except illustrations of stamps and paper money in philatelic or numismatic advertising of legitimate numismatists and dealers in stamps or publishers of or dealers in philatelic or numismatic articles, books, journals, newspapers, or albums). Illustrations permitted by the foregoing provisions of this section shall be made in accordance with the following conditions

"(i) all illustrations shall be in black and white, except that illustrations of postage stamps issued by the United States or by any foreign government may be in color;

"(ii) all illustrations (including illustrations of uncanceled postage stamps in color) shall be of a size less than three-fourths or more than one and one-half, in linear dimension, of each part of any matter so illustrated which is covered by subparagrah (A), (B), (C), or (D) of this paragraph, except that black and white illustrations of postage and revenue stamps issued by the United States or by any foreign government and colored illustrations of canceled postage stamps issued by the United States may be in the exact linear dimension in which the stamps were issued; and

"(iii) the negatives and plates used in making the illustrations shall be destroyed after their final use in accordance with this section.".

SEC. 2. (a) The table of contents of chapter 31 of title 39, United States Code, is amended by striking out

"2506. Printing of black-and-white illustrations of United States stamps." and inserting in lieu thereof

(b) The section heading of section 2506 of title 39, United States Code, is amended to read

❝g 2506. Printing of black-and-white or color illustrations of United States stamps"

(c) Section 2506 (a) of title 39, United States Code, is amended by inserting "or in color" immediately following the words "in black and white".

To authorize the Bureau of Prisons to assist State and local governments in the improvement of their correctional systems.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled. That section 4042 of title 18, United States Code, is amended by striking out the period and inserting a semicolon and by adding the following at the end of the first paragraph:

"(4) Provide technical assistance to State and local ments in the improvement of their correctional systems." Approved July 1, 1968.

An Act

To prohibit desecration of the flag, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That chapter 33 of title 18, United States Code, is amended by inserting immediately preceding section 701 thereof, a new section as follows:

"(a) Whoever knowingly casts contempt upon any flag of the 713.
United States by publicly mutilating, defacing, defiling, burning, or
trampling upon it shall be fined not more than $1,000 or imprisoned
for not more than one year, or both.

"(b) The term 'flag of the United States' as used in this section, shall include any flag, standard, colors, ensign, or any picture or rep- United States." resentation of either, or of any part or parts of either, made of any substance or represented on any substance, of any size evidently purporting to be either of said flag, standard, colors, or ensign of the United States of America, or a picture or a representation of either, upon which shall be shown the colors, the stars and the stripes, in any number of either thereof, or of any part or parts of either, by which the average person seeing the same without deliberation may believe the same to represent the flag, standards, colors, or ensign of the United States of America.

"(c) Nothing in this section shall be construed as indicating an intent on the part of Congress to deprive any State, territory, possession, or the Commonwealth of Puerto Rico of jurisdiction over any offense over which it would have jurisdiction in the absence of this section." SEC. 2. The analysis of chapter 33 of title 18, United States Code, is amended by inserting at the beginning thereof the following:

the District of Columbia, shall publicly mutilate, deface, defile or defy, trample upon, or cast contempt, either by word or act, upon any such flag, standard, colors, or ensign,".

An Act

To repeal section 1727 of title 18, United States Code, so as to permit prosecution of postal employees for failure to remit postage due collections, under the postal embezzlement statute, section 1711 of title 18, United States Code.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That (a) section 1727 of title 18, United States Code, is hereby repealed; and (b) The table of contents for chapter 83 of title 18, United States Code, is amended by striking therefrom

"1727. Postage accounting."

SEC. 2. Nothing in this Act shall be construed to affect in any way any prosecution for any offense occurring prior to the date of enactment of such Act.
