SEC. 501. When used in this Act

(1) The term "industry affecting commerce" means

7 any industry or activity in commerce or in which a labor

8 dispute would burden or obstruct commerce or tend to burden

9

or obstruct commerce or the free flow of commerce.

(2) The term "strike" includes any strike or other con11 certed stoppage of work by employees (including a stoppage 12 by reason of the expiration of a collective-bargaining agree13 ment) and any concerted slow-down or other concerted inter14 ruption of operations by employees.

15 (3) The terms "commerce", "labor disputes", "em16 ployer", "employee", "labor organization", "person", and 17 "supervisor" shall have the same meaning as when used 18 in the National Labor Relations Act as amended by this Act.

20 SEC. 502. Nothing in this Act shall be construed to 21 require an individual employee to render labor or service 22 without his consent, nor shall anything in this Act be con23 strued to make the quitting of his labor by an individual

employee an illegal act; nor shall any court issue any

25 process to compel the performance by an individual employee

1 of such labor or service, without his consent; nor shall the 2 quitting of labor by an employee or employees in good

3 faith because of abnormally dangerous conditions for work

at the place of employment of such employee or employees

5 be deemed a strike under this Act.

SEPARABILITY

SEC. 503. If any.provision of this Act, or the applica

8 tion of such provision to any person or circumstance, shall

9

be held invalid, the remainder of this Act, or the application 10 of such provision to other persons or circumstances than

12

those to which it is held shall not be affected thereby.

SHORT TITLE

SEC. 504. This Act may be cited as the "Federal Labor

14 Relations Act of 1947".

To prescribe fair and equitable rules of conduct to be observed by labor and management in their relations with one another which affect commerce, to protect the rights of individual workers in their relations with labor organizations whose activities affect commerce, to recognize the paramount public interest in labor disputes affecting commerce that endanger the public health, safety, or welfare, and for other purposes. 1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled,

SECTION 1. (a) This Act may be cited as the "Labor

5 Management Relations Act, 1947".

(b) Industrial strife which interferes with the normal

flow of commerce and with the full production of articles and 2 commodities for commerce, can be avoided or substantially 3 minimized if employers, employees, and labor organizations 4 each recognize under law one another's legitimate rights in 5 their relations with each other, and above all recognize under 6 law that neither party has any right in its relations with any 7 other to engage in acts or practices which jeopardize the 8 public health, safety, or interest.

9 It is the purpose and policy of this Act, in order to 10 promote the full flow of commerce, to prescribe the legiti11 mate rights of both employees and employers in their rela12 tions affecting commerce, to provide orderly and peaceful 13 procedures for preventing the interference by either with 14 the legitimate rights of the other, to protect the rights of 15 individual employees in their relations with labor organiza16 tions whose activities affect commerce, to encourage the 17 peaceful settlement of labor disputes affecting commerce by 18 giving the employees themselves a direct voice in the bar19 gaining arrangements with their employers, to define and 20 proscribe practices on the part of labor and management 21 which affect commerce and are inimical to the general wek 22 fare, and to protect the rights of the public in connection 23 with labor disputes affecting commerce.

SEC. 101. The National Labor Relations Act is hereby

4 amended to read as follows:

"POLICY

"SECTION 1. It is hereby declared to be the policy of

7 the United States to climinate the causes of certain sub8 stantial obstructions to the free flow of commerce and to 9 mitigate and eliminate these obstructions when they have 10 occurred by providing means for protecting the rights of 11 employers, employees, and their representatives in their 12 relations one with the other, and for preventing the com13 mission by either of unfair labor practices.

"(1) The term 'person' includes one or more indi17 viduals, partnerships, associations, corporations, labor organ18 izations, legal representatives, trustees, trustees in bank19 ruptcy, or receivers.

"(2) The term 'employer' includes any person acting 21 as an agent of an employer, directly or indirectly, but 22 shall not include the United States or any instrumentality 23 thereof, or any State or political subdivision thereof, or 24 any person subject to the Railway Labor Act, as amended
