SENATE 71ST CONGRESS 2d Session } { REPORT No. 488 TOLL BRIDGE ACROSS THE OHIO RIVER, NEAR APRIL 21, 1930.-Ordered to be printed Mr. DALE, from the Committee on Commerce, submitted the following REPORT [To accompany S. 1644] The Committee on Commerce, to whom was referred the bill (S. 1644) authorizing the county of Vanderburgh, Ind., to construct, maintain, and operate a toll bridge across the Ohio River at or near Evansville, Ind., have considered the same and report thereon with an amendment, and, as so amended, recommend that the bill do pass. Page 2, lines 1, 2, and 3, after the word "navigation", strike out the words "extending from some point in the county of Vanderburgh, Indiana, across said river to a point opposite on the shore,", and insert in lieu thereof the following: "at or near Evansville, Indiana," The bill thus amended has the approval of the Departments of War and Agriculture, as will appear by the annexed communications, the amendment referred to therein having been incorporated in the bill as reported. So far as the interests committed to this department are concerned, I know of no objection to the favorable consideration of the accompanying bill (S. 1644, 71st Cong., 1st sess.), authorizing the county of Vanderburg, Ind., to construct a toll bridge across the Ohio River at or near Evansville, Ind., if amended as indicated in red thereon. DEAR SENATOR: Receipt is acknowledged of your letter of January 27, transmitting a copy of a bill (S. 3298) with request that the committee be furnished with such suggestions touching its merits and the propriety of its passage as the department might deem appropriate. This bill would extend for one and three years, respectively, from March 2, 1930, the times for commencing and completing the construction of the bridge across the Ohio River at or near Evansville, Ind., authorized by act of Congress approved March 2, 1927, to be built by the State of Indiana. The States of Indiana and Kentucky contemplate the construction of this bridge as a joint proposition and as a Federal-aid project. A project statement for such a bridge has been submitted to this department and has been approved by the Secretary of Agriculture. The matter has been delayed, however, by litigation instituted locally against the State of Indiana, which resulted in the State being enjoined from proceeding with the improvement. However, this may be overcome as the State of Kentucky has instituted a friendly suit in the United States Supreme Court which is scheduled for a hearing in the near future. The department would very strongly urge that the pending bill to extend the time for the State of Indiana to construct this bridge be given favorable consideration. Sincerely, R. W. APRIL 21, 1930.-Ordered to be printed Mr. DALE, from the Committee on Commerce, submitted the following REPORT [To accompany S. 4009] The Committee on Commerce, to whom was referred the bill (S. 4009) granting the consent of Congress to the State of New York to construct, maintain, and operate a free highway bridge across the Hudson River at or near Stillwater, N. Y., have considered the same and report thereon with amendments and as so amended, recommend that the bill do pass. The amendments are as follows: After the enacting clause, strike out all the language down to and including the word "entitled", on line 8, and substitute in lieu thereof the following: That the bridge now being reconstructed across the Hudson River at Stillwater, New York, by the State of New York, if completed in accordance with plans accepted by the Chief of Engineers and the Secretary of War, as providing suitable facilities for navigation, and operated as a free bridge, shall be a lawful structure, and shall be subject to the conditions and limitations of the act entitled. Line 10, after the figures "1906", change the period to a comma and add the following: "other than those requiring the approval of plans by the Secretary of War and the Chief of Engineers before reconstruction of the bridge is commenced." Amend the title so as to read: A bill to legalize a bridge across the Hudson River at Stillwater, New York. The bill thus amended has the approval of the Departments of War and Agriculture, as will appear by the annexed communications, the amendments referred to therein having been incorporated in the bill as reported. The accompanying bill, S. 4009, Seventy-first Congress, second session, proposes to authorize the building of a bridge across the Hudson River at or near Stillwater, N Y., by the State of New York. Under date of October 16, 1929, the State of New York made application to this department for approval of plans for the reconstrution of the bridge across the Hudson River at Stillwater, but in view of the fact that such work was not authorized by Congress, as required by section 9 of the river and harbor act of March 3, 1899, the department was without authority to approve the plans thereof. However, since it was necessary to reconstruct the said bridge without delay, the State of New York was notified that no objection would be interposed to the reconstruction work in accordance with the plans submitted, but an act of Congress should be obtained to legalize the structure. Accordingly, the bill has been amended to harmonize with the facts cited above and as thus amended I know of no objection to its favorable consideration. PATRICK J. HURLEY, Secretary of War. Hon.
