at a port in the United States from preventing temporarily the departure from or entry into the United States, including the Canal Zone and all territories, continental or insular, subject to the jurisdiction of the United States, of a citizen of the United States or a person who owes allegiance to the United States notwithstanding the fact that such person may bear a valid passport, card of identification, or other document of identity issued by or under authority of the Secretary of State or be destined for or arriving from a place outside any such territory of the United States for which a valid passport is not required under these rules and regulations. 58.8 Attempt of a citizen or national to enter without a valid passport. If any person who alleges that he is a citizen of the United States or a person who owes allegiance to the United States attempts to enter any territory of the United States contrary to the provisions of the regulations in this part, the appropriate officer of the United States at the port at which the attempt is made to enter such territory, if satisfied that such person is a citizen of the United States or a person who owes allegiance to the United States, shall detain such persons and immediately report the facts in the case to the Secretary of State and await his instructions. 58.9 Optional use of a valid passport. Nothing in the rules and regulations in this part shall be construed to prevent the use of a valid passport by any citizen of the United States, or a person who owes allegiance to the United States, in a case in which a passport is not required by such rules and regulations. 58.10 Discretional exercise of authority in passport mat ters. Nothing in the rules and regulations in this part shall be construed to prevent the Secretary of State from exercising the discretion resting in him to refuse to issue a passport, to restrict its use to certain countries, to withdraw or cancel a passport already issued, or to withdraw a passport for the purpose of restricting its validity or use in certain countries. 58.11 Definition of the term "continental United States."
