Puerto Rico, by act of February 12, 1940 (54 Stat. 22).

Executive Order No. 8678, February 11, 1941, supersedes Executive Order No. 8337, February 3, 1940, and places certain described lands in Puerto Rico under the control and jurisdiction of the War Department for use as an engineer depot for national defense purposes. By Executive Order No. 8867, August 22, 1941, a specified portion of the La Puntilla military reservation, San Juan, P. R., was transferred to the Treasury Department.

Puerto Rico; interchange of property between United States and insular Government.-* :: * Provided, That the President may from time to time, in his discretion, convey to the people of Puerto Rico such lands, buildings, or interests in lands or other property now owned by the United States and within the territorial limits of Puerto Rico as in his opinion are no longer needed for purposes of the United States. And he may from time to time accept by legislative grant from Puerto Rico any lands, buildings, or other interests or property which may be needed for public purposes by the United States * * * Sec. 7, act of Mar. 2, 1917 (39 Stat. 954); 48 U.S. C. 748.

This section was omitted from the original text of the Military Laws.

The act of April 10, 1943 (57 Stat. 61), authorizes the Secretary of War to convey to the people of Puerto Rico a certain portion of the San Juan Military Reservation, San Juan, Puerto Rico.

The act of December 6, 1944 (58 Stat. 794), authorizes the Secretary of War to convey to the people of Puerto Rico the Mayaguez Barracks Military Reservation, to be used for educational purposes.

2142. Virgin Islands; laws applicable.

By Executive Order No. 8858, August 19, 1941, certain lands on Crown Mountain, Island of St. Thomas, Virgin Islands, were transferred from the Interior Department to the War Department for national defense purposes.

Notes of Decisions

In general.-Defendant was prosecuted for wearing distinctive parts of the uniform of the United States Army, in violation of sec. 125. National Defense Act, as amended. There was evidence that defendant, a second lieutenant of Infantry in the Maryland State Guard (home guard), who had served honorably as a sergeant in the United States Army during the first World War, wore his uniform as a state guard officer at a meeting of members of the Order of the Purple Heart, to which he belonged, held in Florida. Judgment of guilty. Held:

lieutenant are a distinctive part of the uniform of the United State Army. Defendant's World War service did not entitle him to wear them because he was only a sergeant in that war and because the meeting was not an "occasion of ceremony" within the meaning of sec. 125, N. D. A. The Maryland State Guard is restricted to use within the State and defendant's membership in it did not entitle him to wear its uniform in Florida. U. S. v. Herting (D. C., S. D.
