OREGON

OREGON REVISED STATUTES-§ 162.720, § 250.210, § 332.100

§ 162.720: Makes punishable by a fine of not less than $20 nor more than $100 any person who: (1) For exhibition or display, places or causes to be placed any words, figure, numbers, marks, inscription, pictures, design, device, symbol, token, notice, drawing or any advertisement of any nature upon any flag of the United States. (2) Exposes or causes to be exposed to public view, any flag of the United States, upon which is printed, painted, or otherwise placed, or to which is attached, appended, affixed or annexed any words, figures, numbers, marks, inscriptions, pictures, designs, device, symbol, token, notice, drawing or any advertisement of any nature, or kind. (3) Exposes to public view, manufactures, sells, exposes for sale or has in possession for sale or use, any article, thing or substance, being an article for a receptacle of merchandise, upon which is printed, painted, attached or otherwise placed, a representation of any flag of the United States, to advertize, call attention to, decorate, ornament, mark of distinguish the article or thing on which it is placed. (4) Publicly mutilates, tramples upon, or publicly defaces, defiles, defies or by words or acts casts contempt upon any flag of the United States.

§ 332.100: The flag of the United States shall be displayed upon or near each trance in front of all polling places throughout voting hours during all primary and general elections.

§ 332.100: The flag of the United States shall be displayed upon or near each public school building during school hours, except in unsuitable weather and at such other times as the school board deems proper.

PENNSYLVANIA

18 § 4210: Makes guilty of a misdemeanor any one who, willfully and maliciously, takes down, pollutes, injures, removes or in any manner damages or destroys any American flag which now or hereafter may be placed on any private or public building or place, or on any public or private highway or any public or private grounds. Punishment shall be by fine not exceeding five hundred dollars or imprisonment not exceeding one year, or both.

18 § 4211: Makes guilty of a misdemeanor any person who, in any manner, for exhibition or display, places or causes to be placed any word, figure, mark, picture, design, drawing, or any advertisement, of any nature, upon any flag, standard, color or ensign of the United States; or exposes or causes to be exposed to public view any such flag, standard, color or ensign upon which shall be printed, painted or otherwise placed, or to which shall be attached, appended, affixed or annexed, any word, figure, mark, picture, design, or drawing or any advertisement, of any nature; or exposes to public view, manufactures, sells, exposes for sale, gives away, or has in possession for sale or for gift, or for use, for any purpose, any article or substance, being an article of merchandise or a receptacle of merchandise, upon which shall have been printed, painted, attached or otherwise placed a representation of any such flag, standard, color or ensign,

to advertise, call attention to, decorate, mark or distinguish, for the purpose of sale, barter or trade, the article or substance on which so placed; or publicly or privately mutilates, defaces, defiles or tramples upon, or casts contempt either by words or not upon, any such flag, standard, color or ensign. Punishment shall be by fine not exceeding two hundred dollars or by imprisonment for not more than six months, or both.

18 § 4200: Makes guilty of an offense against this section any one who, being the owner, proprietor, or lessee of any hall, place of amusement, auditorium, tent, or room used for entertainment of the public, for public gatherings, or public meetings, permits the holding of any entertainment, public gathering, or public meeting, unless the flag of the United States is publicly displayed in such hall, place of amusement, auditorium, tent or room. Makes guilty of an offense against this section any person who, being directly or indirectly in charge of any entertainment, public gathering, or public meeting, on any public street or highway or lot or tract of land, proceeds with the holding of any such entertainment, public gathering, or public meeting, unless the flag of the United States, reasonably clean and in good repair, is publicly displayed at such entertainment, gathering, or meeting. Punishment shall be by fine not exceeding one hundred dollars and is defaut of fine and costs imprisonment not exceeding thirty days. 24 87-771: The flag of the United States shall be displayed upon or near each public school building in clement weather and shall be displayed within all school buildings of all public, private and parochial schools during each day such schools are in session.

16 § 5122: The flag shall decorate the graves of all deceased service persons on each Memorial Day.

44 41: The national flag shall be raised on the capitol building at all times. 44 § 29: The governor is authorized to proclaim America Loyalty Day, to order the national flag to be displayed on all public buildings, and to call upon all citizens to display the national flag from their homes on May first of each year.

RHODE ISLAND

GENERAL LAWS OF RHODE ISLAND-§§ 11-14-2, 16-9-10

§ 11-15-2: Makes guilty of a misdemeanor any person who in any manner, for exhibition or display, shall place or cause to be placed any word, figure, mark, picture, design, drawing, or advertisement of any nature upon any flag, standard, color, or ensign of the United States, or shall expose or cause to be exposed to public view any such flag, standard, color, or ensign upon which shall be printed, painted or otherwise placed, or to which shall be attached, appended, affixed or annexed, any word, figure, mark, picture, design, or drawing, or any advertisement of any nature, or who shall expose to public view, manufacture, sell, expose for sale, give away or have in possession for sale or to give away, or for use for any purpose, any article or substance, being an article of merchandise, or a receptacle of merchandise, upon which shall have been printed, painted, attached or otherwise placed a representation of any such flag, standard, color, or ensign, to advertise, call attention to, mark or distinguish the article or substance on which so placed, or who shall publicly mutilate,, deface, defile or defy, trample upon or cast contempt, either by words or acts, upon any such flag, standard, color or ensign. Punishment shall be by fine not exceeding one hundred dollars or by imprisonment for not more than thirty days, or both.

§ 16-9-10: The flag of the United States shall be displayed upon the public school buildings or premises therein during school hours if in the best judgement of the trustees it be practicable, otherwise at such times as they may direct.

SOUTH CAROLINA

CODE OF LAWS OF SOUTH CAROLINA-§ 16-532, 21-7, 22-6

§ 16-532: Makes guilty of a misdemeanor any person who in any manner, for exhibition or display, shall (a) knowingly place or cause to be placed any word, inscription, figure, mark, picture, design, device, symbol, name, characters, drawing, notice or advertisement of any nature upon any flag, standard, color or ensign of the United States, (b) knowingly display, exhibit, or expose or cause to be exposed to public view any such flag, standard, color or ensign upon which shall have been printed, painted or otherwise placed or to which shall be attached, appended, affixed or annexed any word, inscription, figure, mark, picture, design,

device, symbol, name, character, drawing, photograph, notice, or advertisement of any nature, (c) expose to public view, manufacture, sell, expose for sale, give away or have in possession for sale, to give away, or for use for any purpose, any article or substance, being an article of merchandise or a receptacle of merchandise or article or thing for carrying or transporting merchandise upon which shall have been printed, painted, attached or otherwise placed a representation of any such flag, standard, color or ensign to advertise, call attention to, decorate, mark, or distinguish the article or substance on which placed, or (d) publicly mutilate, deface, defile, defy, jeer at, trample upon or cast contempt, either by word or act, upon any such flag, standard, color, or ensign. Punishment shall be by fine not exceeding one hundred dollars or by imprisonment for not more than thirty days or both.

§ 21-7: The flag of the United States shall be displayed on the grounds of schools supported, in whole or in part, by funds devised from the State.

§ 22-6: The flag of the United States shall be displayed on the grounds of educational institutions supported, in whole or in part, by funds devised from the State.

SOUTH DAKOTA

SOUTH DAKOTA CODE-§§ 65.0602, .0603, .0805, 13.0806, 15.2102

No person shall, in any amnner, for exhibit or display: (1) Place or cause to be placed any word, figure, mark, picture, design, drawing, or advertisement of any nature upon any flag, standard, color, ensign or shield of the United States; (2) Expose to public view any such flag, standard, color, ensign or shield upon which shall have been printed, painted, or otherwise produced, or to which shall have been attached, appended, affixed, or annexed any such word, figure, mark, picture, design, drawing, or advertisement; or (3) Expose to public view for sale, manufacture or otherwise, or to sell, give or have in possession for sale, for gift, or for use for any purpose, any substance, being an article of merchandise, or receptacle, or thing for holding or carrying merchandise, upon or to which shall have been produced or attached any such flag, standard, color, ensign, or shield, in order to advertise, call attention to, decorate, mark, or distinguish such article or substance.

§ 65.0603-No person shall publicly mutilate, deface, defile, defy, trample upon, or by word or act cast contempt upon any such flag, standard, color, ensign or shield.

$65.605-Makes any violation of above sections a misdemeanor.

§ 13.0805: Any person who shall wilfully and maliciously deface, injure, or destroy any United States flag; or who shall wilfully trail it in the dust with intent to dishonor the same; or who shall affix thereto or thereupon any label, stamp, advertisement, brand, imprint, or portrait, printed or painted, or any emblem, motto, or design not authorized by the laws of Congress and the United States Army regulations, and expose the same to public view, shall be deemed guilty of a misdemeanor.

§ 15.2102: The flag of the United States shall be displayed upon each public school building during school hours of each school day, except in inclement weather.

TENNESSEE

TENNESSEE CODE ANNOTATED-§§ 39-1602, 39-1603, 39-1605, 49-814

§ 39-1602: No person shall, in any manner, for exhibition or display: (a) Place or cause to be placed, any word, figure, mark, picture, design, drawing, or advertisement of any nature upon any flag, standard, color, ensign, or shield of the United States; or (b) Expose to public view any such flag, standard, color, ensign, or shield upon which shall have been printed, painted, or otherwise produced, or to which shall have been attached, appended, affixed, or annexed any such word, figure, mark, picture, design, drawing or advertisement: or (c) Expose to public view for sale, manufacture, or otherwise, or to sell, give, or have in possession for sale, or gift or for use for any purpose, any substance, being an article of merchandise, or receptacle, or thing for holding or carrying merchandise, upon or to which shall have been produced or attached any such flag, standard, color, ensign, or shield, in order to advertise, call attention to, decorate, mark or distinguish such article or substance.

§ 39-1603: No person shall publicly mutilate, deface, defile, defy, trample upon, or by word or act cast contempt upon any such flag, standard, color, ensign or shield.

§ 39-1605: Makes violation of 39-1692 a misdemeanor and punishable by fine of not more than one hundred dollars. Punishment of violation of 39-1603 shall be by fine of not more than two hundred dollars or by imprisonment of not more than sixty days or by both.

§ 49-814: The United States flag shall be displayed on every public school building.

TEXAS

REVISED CIVIL STATUTES OF TEXAS-§ 6138, PENAL CODE § 140, PC § 152

§ 6139: Whoever shall in any manner, for exhibition or display, place or cause to be placed, any word, figure, mark, picture, design, drawing or any advertisement of any nature upon any flag of the United States, or shall expose or cause to be exposed to public view any such flag upon which shall have been printed, painted, or otherwise placed, or to which shall be attached, appended, affixed, or annexed any word, figure, mark, picture, design or drawing or any advertisement of any nature, or who shall expose to public view, manufacture, sell, expose for sale, give away, or have in possession for sale, or to give away, or for use for any purpose, any article or substance being an article of merchandise, or receptacle of merchandise or article or thing for carrying or transporting merchandise, upon which shall have been printed, painted, attached or otherwise placed, a representation of any such flag to advertise, call attention to, decorate, mark or distinguish the article or substance on which so placed, or who shall publicly multilate, deface, defy, or defile, trample upon or cast contempt, either by words or act, upon such flag, shall forfeit a penalty of fifty dollars for each such offense. P.C. § 148: In same words as above prohibits such acts and makes violation of statute punishable by a fine not exceeding one hundred dollars or imprisonment for not more than thirty days or both.

P.S. § 152: Any person who shall within Texas, publicly or privately, mutilate, deface, defile, defy, tramp upon, or cast contempt upon, either by word or act any flag, standard, color, or ensign of the United States, shall be confined in the penitentiary not less than two nor more than twenty-five years.

UTAH

UTAH CODE ANNOTATED §§ 75-14-1, 20-7-16, 53-23-1

§ 67-14-1-Makes guilty of a misdemeanor any person who in any manner, for exhibition or display, places or causes to be placed any word, figure, mark, picture, design, drawing or any advertisement of any nature upon any flag, standard, color or ensign of the United States, or who exposes or causes to be exposed to public view any such flag, standard, ensign or color upon which is printed, painted, or otherwise placed, or to which is attached, appended, affixed or annexed any word, figure, mark, picture, design or drawing, or any advertisement of any nature or who exposes to public view, manufactures, sells, exposes for sale, gives away, or has in possession for sale or to give away, or for use for any purpose, any article or substance being an article of merchandise or a receptacle of merchandise, upon which has been printed, painted, attached or otherwise placed a representation of any such flag, standard, color or ensign, to advertise, call attention to, decorate, mark or distinguish the article or substance on which it is so placed, or who publicly mutilates, defaces, defiles, or tramples upon or cast contempt upon, either by word or act, any such flag, standard, color or ensign. Punishment shall be by fine not exceeding $100 or by imprisonment for not more than thirty days, or both.

§ 20-7-16-The flag of the United States shall be displayed at or near each polling place during all general and school elections.

§ 53-23-1-The flag of the United States shall be displayed on each schoolhouse every school day, during school hours and during the daylight hours of every national and state holiday and on Flag Day of each year except in case of rain, snow or high wind.

VERMONT

VERMONT STATUTES ANNOTATED-13 § 1902, 1903, 24 § 132, 16 § 3742

13 § 1902: A person shall not, in any manner, for exhibition or display: (1) Place or cause to be placed any word, figure, mark, picture, design, drawing or advertisement of any nature upon any flag, standard, color, ensign or shield of the United States; (2) Expose to public view any such flag, standard, color,

design or shield upon which shall have been printed, painted or otherwise produced, or to which shall have been attached, appended, affixed or annexed any such word, figure, mark, picture, design, drawing or advertisement; or (3) Expose to public view for sale, manufacture, or otherwise, or sell, give or have in possession for sale, for gift or for use for any purpose any substance, being an article of merchandise, or receptacle, or thing for holding or carrying mer chandise, upon or to which shall have been produced or attached any such flag, standard, color, ensign or shield, in order to advertise, call attention to, decorate, mark or distinguish such article or substance.

13 § 1903: A person shall not publicly mutilate, deface, defile, defy, trample upon, or by word or act cast contempt upon any such flag, standard, color, ensign or shield.

13 § 1905: Makes violation of above punishable by imprisonment for not more than one year or by fine not to exceed $1000, or both.

24 § 132: The flag of the United States is to be displayed in the court room in the county courthouse. On legal holidays and commemorations of historic events such flag shall be displayed on the courthouse or grounds.

16 § 3742: The flag of the United States shall be displayed on each schoolhouse, or on the premises belonging thereto, while school is in session. The flag may be displayed in such schoolhouse.

VIRGINIA

CODE OF VIRGINIA-§ 18.1-424, § 18.1-425, § 18.1-427, § 2-21, § 22-165, § 17-19.1 § 18.1-424: No person shall, in any manner, for exhibition or display: (1) Place or cause to be placed any word, figure, mark, picture, design, drawing or advertisement of any nature upon any flag, standard, color, ensign or shield of the U.S.; (2) Expose to public view any such flag, standard, color, ensign or shield upon which shall have been printed, painted or otherwise produced, or to which shall have been attached, appended, affixed or annexed, any such word, figure, mark, picture, design, drawing or advertisement; or (3) Expose to public view for sale, manufacture or otherwise, or sell, give or have in possession for sale, for gift or for use for any purpose, any substance, being an article of merchandise, or receptacle, or thing for holding or carrying merchandise, upon or to which shall have been produced or attached any such flag, standard, color, ensign or shield, in order to advertise, call attention to, decorate, mark or distinguish such article or substance.

§ 18.1-425: No person shall publicly mutilate, deface, defile, trample upon, or by word or act cast contempt upon any such flag, standard, color, ensign or shield.

§ 18.1-427: Makes violation of § 18.1-424 punishable by a fine not exceeding $100, or by imprisonment for not more than 30 days, or by both.

§ 2-21: Authorizes the Governor to issue annually a proclamation calling upon State officials to display the flag of the United States on all public buildings and the people of the State to display such flag at their homes and other suitable places on Mother's Day, as a public expression of love and reverence for the mothers of this State.

§ 22-165: The flag of the United States is to be flown over each school during school hours of each day in the year, from the hour of opening until the hour of closing the school, except upon such days as injury to the flag would be likely to result from flying it by reason of inclement weather conditions.

§ 17-19.1: There shall be displayed inside each courtroom of a court of record in the cities and counties of the Commonwealth the flag of the United States.
