A BILL To amend title 4 of the United States Code in order to increase the penalty for certain acts against the flag of the United States, and for other purposes

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That (a) section 3 of title 4 of the United States Code is amended (1) by inserting "(a)" immediately before "Any person", and (2) by striking out in the first sentence thereof "; or who within the District of Columbia, shall publicly multilate, deface, defile or defy, trample upon, or cast contempt, either by word or act, upon any such flag, standard, colors, or ensign".

(b) The second sentence of such section is amended by striking out "The words 'flag, standard, colors, or ensign', as used herein" and inserting in lieu thereof the following: "The words 'flag, standard, colors, or ensign', as used in this section".

(c) Such section 3 is further amended by adding at the end thereof the following:

"(b) Any person who shall publicly mutilate, deface, defile, or trample upon any flag, standard, colors, or ensign, shall be fined not more than $1,000 or imprisoned for not more than one year, or both."

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the first sentence of section 3 of title 4, United States Code, is amended by striking out ", within the District of Columbia," each place it appears in such sentence.

And further, that the first sentence of section 3 of title 4, United States Code, is amended by striking out “$100” and inserting "$1,000.00”.

And further, that the first sentence of section 3 of title 4, United States Code, is amended by striking out "thirty days" and inserting "one year".

"(b) Whoever publicly mutilates, defaces, defiles, defies, tramples upon, or casts contempt, either by word or act, upon any flag, standard, colors, or ensign of the United States shall be punished by imprisonment of not more than one year and a fine of not more than $1,000."

A BILL To amend section 3 of title 4 of the United States Code to prohibit the mutilation of the flag anywhere in the United States, and for other purposes

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 3 of title 4 of the United States Code is amended—

(1) by striking out "within the District of Columbia" each place it appears and inserting in lieu thereof "within the United States"; and

(2) by striking out “$100" and "thirty days" and inserting in lieu thereof "$1,000" and "ninety days", respectively.

(1) by redesignating the first sentence as subsection (a);

(3) by redesignating the second sentence as subsection (c);

(4) by striking out "herein" in subsection (c) (as so redesignated by paragraph (3)) and inserting in lieu thereof "in this section"; and

(5) by inserting after subsection (a) the following new subsection:

"(b) Whoever publicly mutilates, defaces. defiles, defies, tramples upon, or casts contempt, either by word or act, upon any flag, standard, colors, or ensign of the United States shall be punished by imprisonment of not more than five years or a fine of not more than $5,000, or both."
