The record of the proceedings of the general court-martial in the foregoing case of Capt. Jacques de L. Lafitte, Twelfth Infantry, having been submitted to the President, he approved and confirmed the sentence therein imposed.

Capt. Jacques de L. Lafitte ceases to be an officer of the Army from September 6, 1912.

Before a general court-martial which convened at Fort Santiago, Manila, P. I., pursuant to Special Orders, No. 173, Philippines Division, July 26, 1911, and of which Lieut. Col. WILLIAM J. NICHOLSON, Seventh Cavalry, was president, and Maj. LEWIS E. GOODIER, judge advocate, was judge advocate, was arraigned and tried

Capt. Boss Reese, Philippine Scouts.

CHARGE I.-" Conduct to the prejudice of good order and military discipline, in violation of the 62d Article of War." Eleven specifications.

CHARGE II.-"Disobedience of orders, in violation of the 21st Article of War."

Specification.-"In that Captain Boss Reese, Philippine Scouts, having been ordered in and by Special Orders, No. 222, Headquarters, Philippines Division, dated October 4, 1909, to conduct an examination of certain officers at Puerto Princesa, Palawan, P. I., under and pursuant to the provisions of Section 8, General Orders, No. 56, Headquarters, Philippines Division, dated August 25, 1909, did wilfully disobey said order, did turn over the conduct of said examination to Captain Julian De Court, Philippine Scouts, one of the officers to be examined, and did quit the room and house in which the examination was to take place, and remain absent during the entire time of the examination in disobedience of said General Orders, No. 56. This at Puerto Princesa, Palawan, P. I., on or about October 31, 1909."

CHARGE III.—“Drunkenness on duty, in violation of the 38th Article of War."

Specification 1.-"In that Captain Boss Reese, Philippine Scouts, being in command of the troops of the post at parade, was found drunk. This at Puerto Princesa, Palawan, P. I., on October 6, 1909."

Specification 2.-"In that Captain Boss Reese, Philippine Scouts, being on duty as commanding officer, Puerto Princesa, Palawan, P. I., while at parade and the drill immediately following the parade, was so drunk that he was unfit to per

form properly his duties as an officer. This at Puerto Princesa, Palawan, P. I., on or about October 7, 1909."

Specification 3.-"In that Captain Boss Reese, Philippine Scouts, being on duty as commanding officer, Puerto Princesa, Palawan, P. I., was found drunk by enlisted men of his command, who assisted him to go to his quarters. This at Puerto Princesa, Palawan, P. I., on or about the night of October 31-November 1, 1909."

Specification 4.-"In that Captain Boss Reese, Philippine Scouts, being in command of the troops of the post at parade, was found drunk. This at Puerto Princesa, Palawan, P. I., on November 20, 1909."

Specification 5.-"In that Captain Boss Reese, Philippine Scouts, being on duty as commanding officer and having also assumed the duties of officer of the day, was found drunk. This at Puerto Princesa, Palawan, P. I., on or about November 21, 1909."

Specification 6.-"In that Captain Boss Reese, Philippine Scouts, being on duty in command of the Fourth Company and of the post and as post ordnance officer, was found drunk. This at Puerto Princesa, Palawan, P. I., on or about December 3, 1909."

CHARGE IV.-"Conduct unbecoming an officer and a gentleman, in violation of the 61st Article of War."

Nine specifications.

ADDITIONAL CHARGE I.-"Drunkenness on duty, in violation of the 38th Article of War."

Specification.-"In that Captain Boss Reese, Philippine Scouts, being on duty as commanding officer, was found drunk. This at Puerto Princesa, Palawan, P. I., on or about April 25th, 1910."

ADDITIONAL CHARGE II.-"Conduct to the prejudice of good order and military discipline."

Specification." In that Captain Boss Reese, Philippine Scouts, having as post commander received from his superior officers an official confidential copy of the three courses in firing for the efficiency test and a copy of the method of arriving at the standard of efficiency in small arms firing, prepared at the School of Musketry, Presidio of Monterey, California, and dated December 21, 1909; and well knowing that said courses had been adopted for the proficiency test in the Philippines

Division, and that same were of a confidential nature, did disclose certain of the contents of said papers in the presence of a large number of officers and other persons. This at Puerto Princesa, Palawan, P. I., on or about April 25th, 1910."

ADDITIONAL CHARGE III.-"Conduct unbecoming an officer and a gentleman, in violation of the 61st Article of War." Specification.-"In that Captain Boss Reese, Philippine Scouts, having been called upon by his department commander for an explanation of certain reports to the effect that he, said Reese, had revealed part of the contents of the official confidential copy of the firing courses for the proficiency test for the year 1910 to several officers, did reply as follows:

'2d Indorsement, Puerto Princesa, Pal. P. I., May 20, 1910. Respectfully returned to the Adjutant, Puerto Princesa, P. I., with the following information:

1. The paper referred to is not at present in the document file at this post: it was, but has been withdrawn and is now in the possession of Major James N. Munro, the present commanding officer.

2. The statement that I revealed the contents of the communication in question to “several officers" is false. The only officer to whom contents of this communication were revealed was 1st Lieut. Edwin Y. Miller, U. S. Inf., governor of this province.

I did not consider revealing the contents of this communication to Governor Miller any breach of confidence, as he was in no way interested whatever in the proficiency test of either one of the companies stationed at this place. The instructions contained in this confidential communication state that the contents of same will not be divulged to any person interested in the test.

3. When this letter was received it was placed in the document file of the post for the reason that I am the sole custodian of that file and I considered that the proper place for

same.

4. When the G. C. M. which was in session from April 25th to May 9th, 1910, called upon me to submit the post document file to the members of the court, I inadvertently failed to take out this letter, the members of the court undoubtedly perused the same while examining this file.
