2 1 2 3 4 5 6 7 8 9 10 11 121 14 15 16 17 18 19 220 in a safe, scientific, and orderly manner, and to protect and maintain the environment of the United States and thus safeguard the lives, property, and economic pursuits of American citizens; (2) modification of the weather potentially affects the health and welfare of American citizens and of people living in other nations; (3) provision should be made to encourage con tinued research, development, and experimentation to achieve orderly and beneficial uses of weather modification; (4) the several States should develop, in conjunction with the United States, comprehensive policies and systems of regulation of weather modification activity, in order to protect the interests of their citizens; and (5) agreements and cooperative programs and policies should be developed with other nations with regard to weather modification. (b) It is, therefore, the purpose of this Act to provide 20 for research and development in weather modification, and 21 to institute a comprehensive data-gathering system which 22 will assist in the development, administration, and super23 vision of weather modification in a safe and scientific 24 manner. 3 DEFINITIONS SEC. 3. For the purposes of this Act, the term(1) "weather modification" means any artificially produced change in the composition, behavior, or dynamics of the atmosphere, when such change is produced with intent to alter the weather; (2) "weather modification apparatus" means any device or equipment which may be used to effect any weather modification; (3) "weather modification agent" means any chemical, material, compound, or other substance which may be used to effect any weather modification; (4) "weather modification activity" means the use of any weather modification apparatus or weather modification agent to attempt to effect any weather modification; (5) "agency" means any Federal executive agency, but such term does not include any military department; (6) "military department" means the Department of the Army, the Department of the Navy, the Depart ment of the Air Force, the Coast Guard, or the Central Intelligence Agency; (7) "person" includes any individual. corporation. 1 2 3 4 5 6 7 8 9 10 11 12 13 company, association, firm, partnership, society, or joint stock company, but such term does not include any agency, military department, local government, or State; (8) "holder of a permit" or "holder" means any person who has applied for a permit under section 302 (a) (2) and has been issued a permit by the Secretary under section 302 (c); (9) "State" means the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Trust Territory of the Pacific Islands, or any other territory or possession of the United States; (10) "local government" means any local unit of government, including a county, municipality, city, 14 town, township, or any other unit created under State 3+ law; (11) "Secretary" means the Secretary of Com TITLE I-RESEARCH AND DEVELOPMENT IN 15 16 17 merce. WEATHER MODIFICATION SEC. 101. The Secretary, acting through the personnel 21 and facilities of his Department or under contracts and 22 arrangements with qualified institutions and organizations, 23 shall initiate and carry out a program of research and de24 velopment designed to— 5 (1) identify and evaluate the specific needs for and uses of effective weather modification; (2) determine the types of weather modification activities which are most likely to be successful in meet ing those needs and achieving those uses, and the manner in which such activities may be most effectively carried out; (3) identify the problems which may be created by the conduct of weather modification activities, and the ways in which such problems can best be avoided; and (4) otherwise provide continuing scientific support for efforts to carry out weather modification activities in a safe and orderly manner which is consistent with the objectives of this Act. TITLE II-WEATHER MODIFICATION INFORMATION SYSTEM 17 SEC. 201. (a) The Secretary shall establish, within the 18 National Oceanic and Atmospheric Administration, a 19 weather modification information system. The purpose of 20 such system shall be to monitor daily weather conditions, 21 to record and evaluate weather modifications, to appraise the effect which any proposed weather modification activity would have on prevailing weather conditions, and to monitor 24 weather modification activity. 6 1 2 3 4 5 6 7 8 9 10 11 (b) The Secretary shall (1) employ such system to assist him in carrying out his functions under title III; (2) obtain data and information from the Weather Bureau on a timely basis to assist in the operation of such system; and (3) use such system to maintain records of any weather modification and weather modification activity conducted in any State. (c) The Secretary shall develop, establish, and maintain a computerized data processing system to facilitate the oper12 ation of the weather modification information system. 13 TITLE III-WEATHER MODIFICATION CONTROL, REPORTING REQUIREMENTS, AND PENALTIES 14 15 16 SEC. 301. (a) Any State which establishes a system to regulate any weather modification activity shall require 17 that any person engaging in such activity in such State 18 obtain a license from such State. Such license shall require 19 that such person disclose (1) his qualifications, education, training, and rele vant experience in weather modification; (2) a legal description of the location of the proposed weather modification and weather modification activity; and |
