Universal Military Training and Service Act

Appointment.

(7) BI Notwithstanding any other provision of law, except section 314 of the Immigration and Nationality Act Allein (66 Stat. 163, 241), no person liable for induction 8 USC 1425. under this subsection shall be held to be ineligible for appointment as a commissioned officer of an armed force of the United States on the sole ground that he is not a citizen of the United States or has not made a declaration of intent to become a citizen thereof: Provided, That any such person who is not a citizen of the United States, who is appointed as a commissioned officer, may in lieu of the oath prescribed by section 1757 of the Revised Statutes, as amended (5 U. S. C. 16), take such oath of service and obedience as the Secretary of Defense may prescribe.

Act

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That subsection 4 (i) of the Universal Military Training and Service Act (64 Stat. 826), as amended, is further amended by adding at the end thereof the following new paragraphs:

"(7) Notwithstanding any other provision of law, except section 314 of the Immigration and Nationality Act (66 Stat. 163, 241), no person liable for induction under this subsection shall be held to be ineligible for appointment as a commissioned officer of an armed force of the United States on the sole ground that he is not a citizen of the United States or has not made a declaration of intent to become a citizen thereof: Provided, That any such person who is not a citizen of the United States, who is appointed as a commissioned officer, may in lieu of the oath prescribed by section 1757 of the Revised Statutes, as amended (5 U. S. C. 16), take such oath of service and obedience as the Secretary of Defense may prescribe."
