The classification of purchases of goods and services into war and nonwar conforms, in general, to the Daily Treasury Statement classification of general and special account expenditures. War purchases include also that part of the capital formation of Government enterprises which is attributable to their war activities. Government contributions to the National Service Life Insurance Fund are classified as war; all other Government contributions for social insurance, as nonwar.

REPORT

[To accompany H. R. 700]

The Committee on the Judiciary, to whom was referred the bill (H. R. 700) for the relief of Anthony Arancio, having considered the same, report favorably thereon without amendment and recommend that the bill do pass.

The purpose of the proposed legislation is to pay the sum of $5,000 to Anthony Arancio, of New York, N. Y., in full settlement of all claims against the United States for personal injuries sustained as a result of being injured by a United States soldier while acting as a member of the New York City Police Department in line of duty on October 1, 1944.

STATEMENT OF FACTS

The evidence shows that on September 30, 1944, Private Red Pace was assigned to a tour of military police duty at the Booker T. Washington USO in Stapleton, Staten Island, N. Y., such tour of duty being from 7:30 p. m. until midnight. Before going on duty he reported to the company supply room where he was issued a pistol. No ammunition was issued but Private Pace says that he found one shell in the pistol and he said nothing about this to the charge of quarters. When Private Pace completed his tour of duty, instead of returning to camp, as he was under orders to do, he visited several bars in the vicinity and became drunk. He then became extremely disorderly, annoying other customers in the bars and in the restaurant which he also entered, and otherwise causing a disturbance. When he drew his pistol and fired it at a passing car the police were called.

A police car with four patrolmen arrived a few minutes later. When the police approached Private Pace, he had his pistol in one hand and his club in the other, and was swinging the club in a threatening manner. The police approached him, trying to talk him into
