AUTHORIZE ATTENDANCE OF MARINE BAND AT SPANISH-AMERICAN WAR VETERANS' CONVENTION AT NEW ORLEANS

Mr. HALE, from the Committee on Naval Affairs, submitted the following

REPORT

[To accompany H. R. 14680]

The Committee on Naval Affairs of the House of Representatives, to whom was referred the bill (H. R. 14680) to authorize the attendance of the Marine Band at the Spanish-American War veterans' convention at New Orleans, having had the same under consideration, report favorably thereon with the following amendments, and recommend that the bill do pass.

Line 5, before the words "Spanish-American War veterans'" insert the word "United," and before the word "convention" insert the word "national."

This bill provides for the authorization of the United States Marine Band to attend and give concerts at the Spanish-American War Veterans' National Convention to be held at New Orleans, La., on September 6 to 10, inclusive, 1931.

The Navy Department interposes no objection to the enactment of this bill, as shown in the following letter from the Acting Secretary of the Navy, addressed to the chairman of the Committee on Naval Affairs of the House of Representatives, which is hereby made a part of this report.

MY DEAR MR. CHAIRMAN: Replying further to the committee's letter of December 6, 1930, transmitting the bill (H. R. 14680) to authorize the attendance of the Marine Band at the Spanish-American War Veterans' convention at New Orleans, and requesting the views and recommendations of the Navy Department thereon, I have the honor to inform the committee as follows: The purpose of this proposed legislation is to authorize the President to permit the band of the United States Marine Corps to attend and give concerts at the Spanish-American War Veterans' convention to be held at New Orleans La., on September 6 to 10, inclusive, 1931. For the purpose of defraying the

expenses of such band in attending and giving concerts at such reunion there is authorized to be appropriated the sum of $8,171.44, or so much thereof as may be necessary to carry out the provisions of this act, and that in addition to transportation and Pullman accommodations the leaders and members of the Marine Band be allowed not to exceed $5 per day each for actual living expenses while on this duty, and that the payment of such expenses shall be in addition to the pay and allowances to which they would be entitled while serving at their permanent station.

In view of the above the Navy Department interposes no objection to the enactment of the bill H. R. 14680.

AUTHORIZING THE SECRETARY OF THE NAVY, IN HIS DISCRETION, TO DELIVER TO THE CUSTODY OF THE STATE OF UTAH THE SILVER SERVICE IN USE ON THE U. S. S. "UTAH"

Mr. WOODRUFF, from the Committee on Naval Affairs, submitted the following

REPORT

[To accompany H. R. 14817]

The Committee on Naval Affairs of the House of Representatives, to whom was referred the bill (H. R. 14817) authorizing the Secretary of the Navy, in his discretion, to deliver to the custody of the State of Utah the silver service in use on the U. S. S. Utah, having had the same under consideration, report favorably thereon, with the following amendments, and recommend that the bill do pass.

Line 4, strike out the words "Utah State Capitol Museum of Salt Lake City, Utah," and insert in lieu thereof the words "State of Utah."

Amend the title so as to read:

A bill authorizing the Secretary of the Navy, in his discretion, to deliver to the custody of the State of Utah the silver service in use on the United States ship Utah.

The following letter from the Secretary of the Navy, addressed to the chairman of the Committee on Naval Affairs of the House of Representatives, sets forth the views of the department on the bill, and is hereby made a part of this report:

MY DEAR MR. CHAIRMAN: Replying further to the committee's letter of December 11, 1930, transmitting the bill (H. R. 14817), authorizing the Secretary of the Navy, in his discretion, to deliver to the custody of the Utah State Capitol Museum, of Salt Lake City, Utah, the silver service in use on the U. S. S. Utah, and requesting the views and recommendations of the Navy Department thereon, I have the honor to invite the committee's attention to the bill (S. 4850) author

izing the Secretary of the Navy to deliver to the Daughters of Utah Pioneers the silver service of the battleship Utah, and the bill (S. 5069) authorizing the Secretary of the Navy to deliver to the State of Utah the silver service which was in use on the battleship Utah, now pending in the United States Senate.

The Navy Department has no objection to the enactment of any one of the bills H. R. 14817, S. 4850, or S. 5069.

WITHDRAWAL OF CERTAIN PUBLIC LANDS FROM ENTRY FOR THE PROTECTION OF WATERSHED FOR LOS ANGELES, CALIF.

Mr. SWING, from the Committee on the Public Lands, submitted the following

REPORT

[To accompany H. R. 11969]

The Committee on the Public Lands, to whom was referred the bill (H. R. 11969) withdrawing certain public lands from entry under the homestead and desert land laws of the United States for the protection of the watershed supplying water to the city of Los Angeles, having considered the same, report it back to the House with the recommendation that the bill do pass with the amendments hereinafter referred to.

The purpose of this bill is to withdraw certain unappropriated public lands of the United States in Inyo and Mono Counties, Calif., from sale or entry to protect the watershed and underground water basin supplying water to the city of Los Angeles.

The lands sought to be withdrawn from entry by this bill have already been temporarily withdrawn upon recommendation of the Secretary of the Interior from all forms of entry under presidential Executive orders issued under act of June 25, 1910 (36 Stat. 847), as amended by act of August 24, 1912 (37 Stat. 497).

The city of Los Angeles maintains and operates a municipally owned water system supplying water to the city and its 1,236,000 inhabitants for domestic purposes. That as a part of its water system the city completed in the year 1913 an aqueduct to convey water from a point on the Owens River in Inyo County, Calif., known as the intake to the city of Los Angeles, Los Angeles County, Calif., a distance of 250 miles at a cost of $24,000,000, capable of delivering 400 second-feet of water. Congress, under the act of June 30, 1906, granted the right of way for this purpose. That since the completion of the aqueduct the city has purchased more than 225,000 acres of water-bearing lands in the Owens River Valley necessary to increase its water supply, at a cost of exceeding $15,185,000, and has thereby succeeded to more than 85 per cent of
