cers, $3,000; sergeants, $2,700; and privates, $2,340. In computing the length of service, credit was given for all service performed within any five-year period, whether or not continuous, as a member of the Capitol Police. A change in the rate of compensation based on the completion of four years service was to be effective on the first day of the first pay period which began after such completion. The Act set the new requirements, as follows:

(d) Section 105 of the Legislative Branch Appropriation Act, 1959 (Public Law 85570) is repealed. Any member of the Capitol Police who prior to the effective date of this section completed service entitling him to be paid at a rate specified in such section 105 shall be entitled, so long as he continues to serve without break in service of more than thirty days as a member of the Capitol Police, to continue to be paid at such rate and, in addition, to receive any longevity increases for which he may become qualified under subsection (b) of this section, except that while receiving compensation at a rate specified in such section 105(1) no such member shall receive more than three longevity increases under subsection (b) based upon any period of continuous service, and (2) in computing length of service for the purpose of such longevity increases, only service performed subsequent to the date on which such member began receiving compensation at a rate prescribed by such section 105 shall be counted.

(e) This section shall become effective on September 1, 1962.44

The Supplemental Appropriations Act of May 17, 1963, P.L. 8825, for the fiscal year ending June 30, 1963, provided an additional sum of $6,500 for the Capitol Police Board. 45

The Legislative Branch Appropriations Act of December 30, 1963, P.L. 88-248, for the fiscal year ending June 30, 1964 provided the following for the Capitol Police:

GENERAL EXPENSES

For purchasing and supplying uniforms; the purchase, maintenance, and repair of police motor vehicles, including two-way police radio equipment; contingent expenses including $25 per month for extra services performed for the Capitol Police Board by such member of the staff of the Sergeant at Arms of the Senate or the House, as may be designated by the Chairman of the Board; $36,700.

CAPITOL POLICE BOARD

To enable the Capitol Police Board to provide additional protection for the Capitol Buildings and Grounds, including the Senate and House Office Buildings and the Capitol Power Plant, $141,000. Such sum shall be expended only for payment of salaries and other expenses of personnel detailed from the Metropolitan Police of the District of Columbia, and the Commissioners of the District of Columbia are authorized and directed to make such details upon the request of the Board. Personnel so detailed shall, during the period of such detail, serve under the direction and instructions of the Board and are authorized to exercise the same authority as members of such Metropolitan Police and members of the Capitol Police and to perform such other duties as may be assigned by the Board. Reimbursement for salaries and other expenses of such detail personnel shall be made to the government of the District of Columbia, and any sums so reimbursed shall be credited to the appropriation or appropriations from which such salaries and expenses are payable and shall be available for all the purposes thereof: Provided, that any person detailed under the authority of this paragraph or under similar authority in the Legislative Branch Appropriations Act, 1942, and the Second Deficiency Appropriation Act, 1940, from the Metropolitan Police of the District of Columbia shall be deemed a member of such Metropolitan Police during the period or periods of any such detail for all purposes of rank, pay, allowances, privileges, and benefits to the same extent as though such detail had not been made, and at the termination thereof any such person who was a member of such police on July 1, 1940, shall have a status with respect to rank, pay, allowances, privileges, and benefits which is not less than the status of

such person in such police at the end of such detail: Provided further, That the Commissioners of the District of Columbia are directed to pay the captain and the lieutenant detailed under the authority of this paragraph the same salary as that paid the two lieutenants so detailed in fiscal year 1955 plus $625 and such increase in basic compensation as may be subsequently provided by law so long as these positions are held by the present incumbents and that the the Commissioners of the District of Columbia are directed to pay the deputy chief detailed under the authority of this paragraph the same salary as that paid in fiscal year 1961 plus $1,025 and such increases in basic compensation as may be subsequently provided by law so long as this position is held by the present incumbent and that the Commissioners of the District of Columbia are directed to pay the uniformed lieutenant detailed under the authority of this paragraph and serving as acting captain a salary of the rank of captain and such increases in basic compensation as may be subsequently provided by law.

No part of any appropriation contained in this Act shall be paid as compensation to any person appointed after June 30, 1935, as an officer or member of the Capitol Police who does not meet the standards to be prescribed for such appointees by the Capitol Police Board: Provided, That the Capitol Police Board is hereby authorized to detail police from the House Office, Senate Office, and Capitol Buildings for police duty on the Capitol Grounds. 46

The Legislative Branch Appropriations Act of August 20, 1964, P.L. 88-454, for the fiscal year ending June 30, 1965, provided the following for the Capitol Police: For the House Office of the Sergeant at Arms, . . . of which $294,175 shall be available only upon adoption by the House of House Resolution 648, 88th Congress (see infra 85 Stat. 144). This resolution passed the House on August 4, 1964, for the hiring of additional Capitol Police personnel: I additional lieutenant, at the basic compensation of $2,340 per annum, 1 additional sergeant at $2,280, and 52 privates at $2,160 per annum, but only 10 privates could be hired on the passage of this resolution; the remaining 42 were to be hired as needed. See text of resolution when enacted into permanent law, P.L. 92-51, July 9, 1971, at infra 85 Stat. 144.

The Act also provided the following for the Capitol Police:

No part of any appropriation contained in this Act shall be paid as compensation to any person appointed after June 30, 1935, as an officer of the Capitol Police who does not meet the standards to be prescribed for such appointments by the Capitol Police Board: Provided, That the Capitol Police Board is hereby authorized to detail police from the House Office, Senate Office, and Capitol Buildings for police duty on the Capitol Grounds. 47

The Act also provided the following changes in basic compensation for lieutenants, special officers, and sergeants, and changes in longevity compensation, as follows:

SEC. 104. (a) The rate of basic compensation of sergeants of the Capitol Police shall be $2,520 per annum, and the rate of basic compensation of lieutenants and special officers of the Capitol Police shall be $2,820 per annum.

(b) The second sentence of section 106(d) of the Legislative Branch Appropriation Act, 1963, is repealed. (see supra 76 Stat. 695)

(c) Any member of the Capitol Police who by reason of the provision repealed by subsection (b) was receiving immediately prior to the effective date of this section, longevity compensation provided by section 105 of the Legislative Branch Appropriation Act, 1959, shall, on and after such effective date, receive in lieu thereof a longevity increase under section 106(b) of the Legislative Branch Appropriation Act, 1963, in addition to any other such increase (not to exceed three) to which he may otherwise be entitled under such section. In computing the length of service of such member for the purpose of such other increases, only services performed subsequent to the date on which he began receiving longevity compensation in accordance with such section 105 shall be counted (see also supra 72 Stat. 453)

(d) This section shall become effective on the first day of the month following the date of enactment of this Act.48

For an additional amount, fiscal year 1964, to reimburse the Commissioners of the District of Columbia for salaries of additional personnel detailed from the Metropolitan Police Department, $22,100.49

The Supplemental Appropriations Act of April 30, 1965, P.L. 8946, for the fiscal year ending June 30, 1965, provided the following for increased pay costs authorized by or pursuant to law, as follows: * Capitol Police Board, $130,566.50

police privates on the Capitol Police Board additional to the number otherwise authorized, $1,044,500." (These privates were part of the 52 authorized by H. Res. 648). The Act also provide the following:

Such sum shall be expended only for payment of salaries and other expenses of personnel detailed from the Metropolitan Police of the District of Columbia and the Commissioners of the District of Columbia are authorized and directed to make such details upon the request of the Board. Personnel so detailed shall, during the period of such detail, serve under the direction and instructions of the Board and are authorized to exercise the same authority as mambers of such Metropolitan Police and members of the Capitol Police and to perform such other duties as may be assigned by the Board. Reimbursement for salaries and other expenses of such detail personnel shall be made to the government of the District of Columbia, and any sums so reimbursed shall be credited to the appropriations or appropriations from which such salaries and expenses are payable and shall be available for all the purposes thereof: Provided, That any person detailed under the authority of this paragraph or under similar authority in the Legislative Branch Appropriation Act, 1942, and the Second Deficiency Appropriation Act, 1940, from the Metropolitan Police of the District of Columbia shall be deemed a member of such Metropolitan Police during the period or periods of any such detail for all purposes of rank, pay, allowances, privileges, and benefits to the same extent as though such detail had not been made, and at the termination thereof any such person who was a member of such police on July 1, 1940, shall have a status with respect to rank, pay, allowances, privileges, and benefits which is not less than the status of such persons in such police at the end of such detail: Provided further, That the Commissioners of the District of Columbia are directed (1) to pay the detective captain detailed under the authority of this paragraph his salary as a detective captain plus $1,625 and such increases in basic compensation as may be subsequently provided by law so long as this position is held by the present incumbent, (2) to pay the uniformed lieutenant detailed under the authority of this paragraph and serving as acting captain a salary of the rank of captain plus $1,625 and such increases in basic compensation as may be subsequently provided by law so long as this position is held by the present incumbent, (3) to pay the acting deputy chief of police detailed under the authority of this paragraph the salary of the rank of deputy chief of police plus $1,625 and such increases in basic compensation as may be subsequently provided by law so long as this position is held by the present incumbent, (4) to pay the detective lieutenant detailed under the authority of this paragraph and serving as acting detective captain the salary of the rank of detective captain and such increases in basic compensation as may be subsequently provided by law, and (5) to pay the detective permanently detailed under the authority of this paragraph and serving as acting detective sergeant the salary of the rank of detective sergeant and such increases in basic compensation as may be subsequently provided by law.

No part of any appropriation contained in this Act shall be paid as compensation to any person appointed after June 30, 1935, as an officer or member of the Capitol Police who does not meet the standards to be prescribed for such appointees by the Capitol Police Board: Provided, That the Capitol Police Board is hereby authorized to detail police from the House Office, Senate Office, and Capitol buildings for police duty on the Capitol Grounds and on the Library of Congress Grounds. 51

The Supplemental Appropriations Act of October 31, 1965, P.L. 89-300, for the fiscal year ending June 30, 1966, provided the following for the Capitol Police:

Individual officers and members of the Metropolitan Police who assisted the Capitol Police Board on August 9, 1965, are authorized to receive overtime pay at basic salary rates for services performed in excess of regular tours of duty at the request of the Board, and the Metropolitan Police Department shall be reimbursed for such payments by the Capitol Police Board from funds available for such purposes. 52

The Legislative Branch Appropriations Act of August 27, 1966, P.L. 89-545, for the fiscal year ending June 30, 1967, for the Sergeant at Arms of the Senate to employ an additional sergeant, Capitol Police force at $2,880 basic per annum, an additional lieutenant, Capitol Police force at $3,480 basic per annum, and 25 additional privates, Capitol Police force at $2,160 basic per annum each: Provided further, that appointees to the Capitol Police force positions authorized herein shall have the equivalent of at least one year's police experience. The Act also provided $95,550 for general expenses including uniforms, the purchase, maintenance, and repair of police motor vehicles, including two-way police radio equipment; contingent expenses, including $25 per month for extra services performed for the Capitol Board by such members of the staff of the Sergeant at Arms of the Senate of the House, as may be designated by the Chairman of the Board. The Act provided the sum of $809,000 to the Capitol Police Board for the payment of salaries and other expenses of personnel detailed from the Metropolitan Police of the District of Columbia. The Commissioners of the District of Columbia were authorized and directed to make such details upon request of the Board. The detailed personnel were to serve under the direction and instructions of the Capitol Police Board. Reimbursement of their salaries and expenses were to be made to the government of the District of Columbia. The detailed personnel retained their rank, pay, allowances, privileges, and benefits to the same extent as though such detail had not been made. The Commissioner of the District of Columbia were directed:

(1) to pay the deputy chief of police detailed under the authority of this paragraph the salary of the rank of deputy chief of police plus $1,625 and such increases in basic compensation as may be subsequently provided law so long as this position is held by the present incumbent, (2) to pay the two detective lieutenants detailed under the authority of this paragraph and serving as acting detective captains the salary of the rank of detective captains plus $1,625 and such increases in basic compensation as may be subsequently provided by law so long as these positions are held by the present incumbents, (3) to pay the detective sergeant detailed under the authority of this paragraph and serving as acting detective lieutenant the salary of the rank of detective lieutenant plus $1,625 and such increases in basic compensation as may be subsequently provided by law so long as this position is held by the present incumbent, and (4) to pay the three detectives permanently detailed under the authority of this paragraph and serving as acting detective sergeants the salary of the rank of detective sergeants and such increases in basic compensation as may be subsequently provided by law.

No part of any appropriation contained in this Act shall be paid as compensation to any person appointed after June 30, 1935, as an officer or member of the Capitol Police who does not meet the standards to be prescribed for such appointess by the Captiol Police Board: Provided, That the Capitol Police Board is hereby authorized to detail police from the House Office, Senate Office, and Capitol buildings for police duty on the Capitol Grounds and on the Library of Congress Grounds.
