AUTHORIZING THE TERRITORY OF HAWAII TO ISSUE BONDS FOR PUBLIC WORKS

Mr. PATTON, from the Committee on the Territories, submitted the following

REPORT

[To accompany H. R. 7378]

The Committee on the Territories, to whom was referred the bill (H. R. 7378) to authorize the Legislature of the Territory of Hawaii to create a public corporate authority authorized to engage in slum clearance and housing undertakings and to issue bonds of the authority, to authorize said legislature to provide for financial assistance to said authority by the Territory and its political subdivisions, and for other purposes, having considered the same, report it back to the House without amendment and recommend that the bill do pass.

In 1935 the Legislature of the Territory of Hawaii created an Hawaii Housing Authority, Act 190, Session Laws of Hawaii, 1935. At the time of the enactment of Act 190 there was a question whether or not it was necessary for Congress to authorize the legislature to do this. It now appears, however, that to make the action of the legislature effective Congress will have to approve and confirm the establishment of a housing authority. During the recent session of the Territorial legislature amendments to Act 190, Session Laws of Hawaii, 1935, were made, being Acts 3 and 179, Session Laws of Hawaii, 1937. H. R. 7378, however, covers these amendments, and when enacted into law would in effect give congressional approval to Act 190, Session Laws of Hawaii, 1935, as amended by Acts 3 and 179, Session Laws of Hawaii, 1937. The legislature adopted Joint Resolution 10, asking Congress to approve of the creation of an Hawaii Housing Authority, which together with Act 190, Session Laws of Hawaii, 1935, and Acts 3 and 179, Session Laws of Hawaii, 1937, were approved by the Governor.

H. R. 7378 is in line with the draft of a bill suggested by the Federal Emergency Administration of Public Works, PW 71856. It should be noted that no expenditure of Federal funds is involved, and that the obligations of the Hawaii Housing Authority will be secured by the projects undertaken, and that such obligations will not be a part of the debt of the Territory of Hawaii.

Mr. CROWE, from the Committee on the Territories, submitted the following

REPORT

[To accompany H. R. 7489]

The Committee on the Territories, to whom was referred the bill (H. R. 7489) to amend an act entitled "An Act to enable the Legislature of the Territory of Hawaii to authorize the issuance of certain bonds, and for other purposes", approved August 3, 1935, having considered the same, report it back to the House without amendment and recommend that the bill do pass.

The last Congress authorized the Territory of Hawaii to issue bonds to the extent of $4,803,000 for the purposes enumerated in Act 174, Session Laws of Hawaii, 1935. This approval became Public, No. 237, Seventy-fourth Congress. By approving of Act 174, Congress adopted the limitation incorporated in that act, which provides that the bonds authorized to be issued must be sold and delivered prior to June 30, 1937. Not all of this bond issue has been sold, the Territorial government disposing of them only as required for public improvements actually being constructed. Thus the present legislature has requested an extension of time to dispose of these bonds until June 30, 1939. It amended Act 174 accordingly by Act 23, Session Laws of Hawaii, 1937. The legislature adopted Joint Resolution 5, asking Congress to approve of this extension of time, both measures having been approved by the Governor.

In compliance with paragraph 2A of rule XIII of the Rules of the House of Representatives, changes in existing law made by the bill are shown as follows (existing law in which no change is proposed is shown in roman; new matter is in italic):

SEC. 2. That the Territory of Hawaii, any provision of the Hawaiian Organic Act or of any Act of this Congress to the contrary notwithstanding, is authorized and empowered to issue bonds in the sum of not to exceed $4,803,000 of the character and in the manner provided in that certain act of the legislature of said Territory, enacted at its regular session of 1935, entitled “An Act to provide for public improvements and for the securing of Federal funds for expenditure in connection with funds hereby appropriated for such improvements”, as amended by Act 23, Session Laws of Hawaii, 1937.

Mr. COLDEN, from the Joint Committee on the Disposition of Executive Papers, submitted the following

REPORT

The joint select committee of the Senate and House of Representatives, appointed on the part of the Senate and on the part of the House of Representatives, to which are referred the reports of the Archivist of the United States in respect to accumulation of records which are not needed or useful in the transaction of the current business of departments, bureaus, etc., and have no permanent value or historical interest (in compliance with sec. 9 of the National Archives Act approved June 19, 1934), respectfully report to the Senate and House of Representatives, pursuant to an act entitled "An act to authorize and provide for the disposition of useless papers in the executive departments", approved February 16, 1889, as amended, as follows:

Your committee have taken action on the records described in the attached reports of the Archivist of the United States, dated April 10, 1937, and May 5, 1937, with respect to records recommended for disposal by the Department of the Treasury, and we find and report that, with the exception of items 1, 2, and 11, of the Procurement Division, in the report dated May 5, 1937, which should be held pending further examination, said records are not needed in the transaction of the current business of such department and have no permanent value or historical interest.

We recommend that as required by law, the Department of the Treasury sell as waste paper or otherwise dispose of all records, with the exception of items 1, 2, and 11, above mentioned, upon the best obtainable terms, after due publication of notice inviting proposals therefor, and receive and pay the proceeds thereof into the Treasury of the United States and make report thereof to Congress.

We recommend that items 1, 2, and 11 be temporarily preserved for the purpose of cooperating with the librarian of the University of

Texas, who requests an opportunity to examine the papers since they
may be pertinent to the history of that part of the United States.
Dr. Herbert Putnam, Librarian, Library of Congress, in a letter dated
May 13, 1937, called the attention of the secretary of the National
Archives Council to these items, stating that there might be in the
letter files, certain letters that would be valued by the library of the
University of Texas, if there be any way of making them available
there. The committee therefore recommends cooperation with the
University of Texas as far as the law will permit.
