AMENDMENTS TO THE INTERNATIONAL CONVENTION ON LOAD LINES, 1966

The Assembly,

Recalling Article 16(j) of the Convention on the International Maritime Organization concerning the functions of the Assembly in relation to regulations concerning maritime safety,

Noting that proposals for amending regulations 47 and 48(2) of the International Convention on Load Lines, 1966, concerning the southern winter seasonal zone and tropical zone off the coast of Chile and the supporting meteorological background information were submitted by the Government of Chile to IMO in accordance with Article 29(3) of the 1966 Load Line Convention and were duly considered by the Maritime Safety Committee,

Noting also that the Maritime Safety Committee at its forty-seventh session adopted the proposed amendments in accordance with Article 29(3)(a) of the 1966 Load Line Convention,

Having considered the amendments to regulations 47 and 48(2) and to the chart of zones and seasonal areas,

1. Adopts, in accordance with Article 29(3)(b) of the International Convention on Load Lines, 1966, the amendments to those regulations the text of which is annexed to the present resolution, together with the consequential changes to the chart of zones and seasonal areas;

2. Requests the Secretary-General, in accordance with Article 29(3)(b) of the 1966 Load Line Convention, to transmit certified copies of the present resolution and its Annex to all Contracting Governments to the 1966 Load Line Convention, for consideration and acceptance, and also to transmit copies to all Members of the Organization;

3. Urges all States concerned to accept the amendments at the earliest possible date.

ANNEX

AMENDMENTS TO THE INTERNATIONAL CONVENTION ON LOAD LINES, 1966

REGULATION 47

Delete at the end of the paragraph "to the west coast of the American continent" and replace by "to the point latitude 33°S, longitude 79°W, thence the rhumb line to the point latitude 41°S, longitude 75°W, thence the rhumb line to Punta Corona lighthouse on Chiloe Island, latitude 41°47'S, longitude 73°53′W, thence along the north, east and south coasts of Chiloe Island to the point latitude 43°20'S, longitude 74°20'W, and thence the meridian of longi

tude 74°20'W to the parallel of latitude 45°45'S, including the inner zone of Chiloe channels from the meridian 74°20′W to the east."

REGULATION 48 (2)

Delete at the end of the paragraph "and thence the rhumb line to the west coast of the American continent at latitude 30°S." and replace by "thence the rhumb line to the point latitude 32°47'S, longitude 72°W, and thence to the parallel of latitude 32°47'S to the west coast of South America.".

CHART OF ZONES AND SEASONAL AREAS

1. Delete the southern border line of the southern summer zone east of the point latitude 33°S, longitude 79°W to the west coast of the American continent. Insert a rhumb line from the point latitude 33°S, longitude 79°W to the point latitude 41°S, longitude 75°W, from there insert a rhumb line to Punta Corona lighthouse on Chiloe Island latitude 41°47'S, longitude 73°53'W, from there mark the north, east and south coast of Chiloe Island as border to the point latitude 43°20'S, longitude 74°20'W, mark the meridian of longitude 74°20'W to the parallel of latitude 45°45'S and then this parallel to the west coast of South America.

2. Delete from the southern boundary of the tropical zone the rhumb line from the point latitude 26°S, longitude 75°W to the west coast of South America at latitude 30°S. Insert a rhumb line from the point latitude 26°S, longitude 75°W to the point latitude 32°47'S, longitude 72°W and then the parallel of latitude 32°47'S to the west coast of South America.

To the Senate of the United States:

With a view to receiving the advice and consent of the Senate to ratification, I transmit herewith the Treaty on Cooperation between the United States of America and the United Mexican States for Mutual Legal Assistance, signed at Mexico City on December 9, 1987.

I transmit also, for the information of the Senate, the report of the Department of State with respect to the Treaty.

The Treaty is one of a series of modern mutual legal assistance treaties being negotiated by the United States in order to counter more effectively trans-border criminal activities. The Treaty should be an effective tool to combat a wide variety of modern criminals including members of drug cartels, "white-collar criminals," and terrorists. The Treaty is self-executing and utilizes existing statutory authority.

The Treaty provides for a broad range of cooperation in criminal matters. Mutual assistance available under the Treaty includes: (1) the taking of testimony or statements of witnesses; (2) the provision of documents, records, and evidence; (3) the execution of requests for searches and seizures; (4) the serving of documents; and (5) the provision of assistance in procedures regarding the immobilizing, securing, and forfeiture of the proceeds, fruits, and instrumentalities of crime.

I recommend that the Senate give early and favorable consideration to the Treaty and give its advice and consent to ratification. RONALD REAGAN.
