1 members. The Commissioner of the District of Columbia shall

2 appoint nine members of the Commission as follows:

"(A) Three members shall be appointed from a panel of six physicians licensed under this Act who are in private practice in the District of Columbia and who are nominated by the Medical Society of the District of Columbia.

"(B) One member shall be appointed from a panel of two physicians licensed under this Act who are nominated by the dean of the Georgetown University Medical School.

"(C) One member shall be appointed from a panel of two physicians licensed under this Act who are nominated by the dean of the George Washington University Medical School.

"(D) One member shall be appointed from a panel of two physicians licensed under this Act who are nominated by the dean of the Howard University Medical School.

"(E) One member shall be appointed from a panel of two osteopathic physicians licensed under this Act who are nominated by the Association of Osteopathic Physicians of the District of Columbia, Incorporated.

"(F) Two members shall be appointed from per

sons who are not physicians and who represent the com

munity at large.

"(2) The Corporation Counsel of the District of Colum

4 bia (or his delegate) and the Director of Public Health of

5 the District of Columbia (or his delegate) shall be ex

6 officio members of the Commission.

"(3) A vacancy in the Commission shall be filled in the 8 same manner as the original appointment was made. 9 "(b) (1) Except as provided in paragraphs (2) and 10 (3) of this subsection, members of the Commission 11 (appointed under paragraph (1) of subsection (a)) shall be 12 appointed for terms of three years.

"(2) Of the members first appointed to the Commission

14 under such paragraph (1)

"(A) three members shall be appointed for terms

of one year,

"(B) three members shall be appointed for terms of two years, and

"(C) three members shall be appointed for terms

of three years,

21 as designated by the Commissioner of the District of Colum

22 bia at the time of appointment.

"(3) Any member of the Commission appointed to fill a

24 vacancy occurring prior to the expiration of the term for

1 which his predecessor was appointed shall be appointed only 2 for the remainder of such term. A member of the Commission

3 may serve after the expiration of his term until his successor 4 has taken office.

"(c) The Commission shall elect a President and a 6 Vice President from among its members. The Director of 7 Public Health of the District of Columbia (or his delegate) 8 shall be the Secretary of the Commission.

"(d) The Commission shall make, and may alter, such 10 rules as it deems necessary to conduct its business. The Com11 mission shall adopt a common seal and from time to time may alter it. The courts shall take judicial notice of the seal.” (b) The Commissioner of the District of Columbia shall 14 appoint the first nine members of the Commission on Licen

sure To Practice the Healing Art, established by section 4 of 16 the Healing Arts Practice Act, District of Columbia, 1928 17 (as amended by this Act), not later than ninety days after 18 the date of the enactment of this Act.

SEC. 2. (a) The Healing Arts Practice Act, District 20 of Columbia, 1928, is amended by redesignating section 21 25 (a) (D.C. Code, sec. 2-122a) as section 25A and by add22 ing after that section the following new section:

"SEC. 25B. (a) The Commission may issue, without 24 examination, temporary licenses to persons holding the degree of doctor of medicine or doctor of osteopathy who wish

to pursue or participate in residency or fellowship training

2 programs in the District of Columbia. An applicant for a

3 temporary license shall furnish to the Commission satisfactory 4 proof that-

"(1) he is at least twenty-one years of age and is

of good moral character;

"(2) he is a graduate of a medical school or an osteopathic school registered under section 5 (a) of this Act or is otherwise qualified after examination by the Educational Council for Foreign Medical Graduates;

"(3) he has been accepted or appointed for residency or fellowship in an accredited program;

"(4) he will limit his practice and training to the confines of the hospitals or other facilities within such accredited program; and

“(5) he will practice only under the supervision of the attending medical staff of such hospitals, facilities, or affiliated institutions within such accredited program. 19 Each applicant for a license under this section must be 20 nominated by the institution in which he is serving as a resi21 dent or fellow. An institution which nominates an applicant 22 for a license under this section shall notify the Commission 23 of the beginning and ending dates of the period for which 24 such applicant has been accepted or appointed.

1 "(b) A license issued under this section shall be valid 2 for a period not to exceed one year. Such a license may be 3 renewed upon application for a period not to exceed one 4 year. A license issued under this section may not be renewed 5 for periods aggregating more than four years.

“(c) The holder of a license under this section may sign

7 birth and death certificates, prescriptions for narcotics, bar8 biturates, and other drugs, and other legal documents in com9 pliance with existing laws, if the execution of such documents 10 involves duties prescribed by or incident to his residency or 11 fellowship program.

"(d) Within sixty days after appointment of any intern 13 to any hospital or institution in the District of Columbia, such 14 hospital or institution shall file with the Commission the name 15 of each such intern and shall furnish such other information 16 concerning such intern as the Commission may require." (b) Sections 6 and 23 of such Act (D.C. Code, sees. 2– 18 104, 2-119) are each amended by striking out "section 25 19 (a)" and inserting in lieu thereof "section 25A".
