TITLE XVI-TITLE OF ACT Sec. 1601. Title of Act. : 3 (1) The term "District" means the District of Columbia. 4 5 (2) The terms "District Council" and "Council" mean 6 the Council of the District of Columbia provided for by 7 title III. 8 (3) The term "District of Columbia Council" means 9 the Council of the District of Columbia established under 10 Reorganization Plan Numbered 3 of 1967. 11 (4) The term "Chairman" means, unless otherwise 12 indicated in this Act, the Chairman of the District Council 13 provided for by title III. 14 (5) The term "Mayor" means the Mayor provided for 15 by title IV. 16 (6) The term "qualified voter," except as otherwise 17 specifically provided, shall have the same meaning as that 18 provided for a “qualified elector" under paragraph (2) of 19 section 2 of the District of Columbia Election Act. 20 (7) The term “act" includes any legislation adopted by 21 the District Council, except where the term "Act" is used 22 to refer to this Act or other Acts of Congress herein specified. 23 (8) The term "District Election Act of 1955" means 24 the Act of August 12, 1955 (69 Stat. 699), as amended. 25 (9) The term "person" includes an individual, partner 6 1 ship, association, joint-stock company, trust, or corporation. 2 (10) The term "capital project", or "project", means 3 (a) any physical public betterment or improvement and any 4 preliminary studies and surveys relative thereto; (b) the 5 acquisition of property of a permanent nature; or (c) the 6 purchase of equipment for any public betterment or improve7 ment when first erected or acquired. 8 (11) The term "pending", when applied to any capital 9 project, means authorized but not yet completed. 10 (12) The term "Board of Elections" means the Board 11 of Elections created by section 3 of the District Election Act 12 of 1955. 13 (13) The term "election", unless the context otherwise 14 indicates, means an election held pursuant to the provisions 15 16 17 18 19 20 225 21 of this Act. (14) The term "domicile" means that place where a person has his true, fixed, and permanent home and to which, when he is absent, he has the intention of returning. (15) The terms "publish" and "publication", unless otherwise specifically provided herein, mean publication in a newspaper of general circulation in the District. 22 (16) The term "municipal courts of the District of 23 Columbia" means the Superior Court of the District of Co 24 lumbia, the District of Columbia Court of Appeals, and such 7 1 other municipal courts as the District Council may hereafter 2 establish by act. 3 4 TITLE II-STATUS OF THE DISTRICT SEC. 201. (a) All of the territory constituting the per5 manent seat of the Government of the United States shall 6 continue to be designated as the District of Columbia. The 7 District of Columbia shall remain and continue a body cor8 porate, as provided in section 2 of the Revised Statutes re9 lating to said District. Said Corporation shall continue to be 10 charged with all the duties, obligations, responsibilities, and 11 liabilities, and to be vested with all of the powers, rights, priv12 ileges, immunities, and assets, respectively, imposed upon 13 and vested in said Corporation, or the Commissioner of the 14 District of Columbia. 15 (b) No law or regulation which is in force on the effec16 tive date of part 2, title III, of this Act shall be deemed 17 amended or repealed by this Act except to the extent specifi18 cally provided herein or to the extent that such law or regu19 lation is inconsistent with this Act: Provided, That any such 20 law or regulation may be amended or repealed by legislation 21 222 or regulation as authorized in this Act, or by Act of Congress. (c) Nothing contained in this section shall affect the 23 boundary line between the District of Columbia and the 24 Commonwealth of Virginia as the same was established or 8 1 may be subsequently established under the provisions of title 2 I of the Act of October 31, 1945 (59 Stat. 552). 6 SEC. 301. There is hereby created a Council of the 7 District of Columbia consisting of eleven members, of whom 8 the Chairman and two members shall be elected at large and 9 the other eight members shall be elected one from each of 10 the eight election wards established under the District of 11 Columbia Election Act. The term of office of the Chairman 12 and other members of the Council shall be four years begin13 ning at noon on January 2 of the odd-numbered year follow14 ing such election; except that of the members (other than the 15 Chairman) first elected after the effective date of this pro16 vision, one member elected at large and four members elected 17 from wards shall serve for terms of two years. The members 18 who shall serve for terms of two years shall be determined 19 by lots cast before the Board of Elections of the District of 20 Columbia upon a date set and pursuant to regulations issued 21 by the Board of Elections. The legislative power granted the 22 District by this Act shall be vested in the Council. 23 24 QUALIFICATIONS FOR HOLDING OFFICE SEC. 302. No person shall hold the office of member of 25 the District Council unless he (1) is a qualified voter, (2) |
