1 Mayor shall be four years, beginning at noon on January 2 2 of the odd numbered years during which the President of the 3 United States takes office.

4 (b) No person shall hold the office of Mayor unless he

5

(1) is a qualified voter, (2) is domiciled and resides in the 6 District, (3) has, during the three years next preceding his 7 nomination, been resident in and domiciled in the District, 8 (4) holds no other elective public office, (5) holds no po9 sition as an officer or employee of the municipal government 10 of the District of Columbia or any appointive office, for 11 which compensation is provided out of District funds, and (6) holds no office to which he was appointed by the Presi13 dent of the United States and for which compensation is

provided out of Federal or District funds. The Mayor shall forfeit his office upon failure to maintain the qualifications required by this section.

(c) The Mayor shall receive an annual salary of $40,000, and an allowance for official reception and representation expenses, which he shall certify in reasonable detail. to the District Council, of not more than $2,500 annually. Such salary shall be payable in periodic installments.

(d) Notwithstanding any other provision of this Act,

the method of election, the qualifications for office, the com

pensation and the allowance for official expenses pertaining

to the office of Mayor may be changed by acts passed by the

1 Council: Provided, That no such act shall take effect until

2 after it has been assented to by a majority of the qualified

3 voters of the District voting at an election on the proposition 4 set forth in any such act.

POWERS AND DUTIES

SEC. 402. The executive power of the District shall be 7 vested in the Mayor who shall be the chief executive officer 8 of the District government. He shall be responsible for the

proper administration of the affairs of the District coming 10 under his jurisdiction or control, and to that end shall have 11 the following powers and functions:

(1) He shall designate the officer or officers of the 13 executive department of the District who shall, during pe14 riods of disability or absence from the District of the Mayor, the Chairman, and the Vice Chairman of the Council, execute and perform all the powers and duties of the Mayor. (2) He shall act as the official spokesman for the District and as the head of the District for ceremonial purposes. (3) He shall administer all laws relating to the appointment, promotion, discipline, separation, and other conditions of employment of personnel in the office of the Mayor, per

sonnel in executive departments of the District, and members of boards, commissions, and other agencies, who, under laws in effect on the effective date of this section, are subject to 25 appointment and removal by the Commissioner of the Dis

1 trict of Columbia. All actions affecting such personnel and 2 such members shall, until such time as legislation is enacted 3 by the Council superseding such laws and establishing a permanent District government merit system or systems, pursuant to section 402 (4), continue to be subject to the 6 provisions of Acts of Congress relating to the appointment, 7 promotion, discipline, separation, and other conditions of 8 employment applicable to officers and employees of the Dis9 trict government, to section 1001 (d) of this Act, and where 10 applicable, to the provisions of the joint agreement between 11 the Commissioners and the Civil Service Commission author12 ized by Executive Order Numbered 5491 of November 18, 13 1930, relating to the appointment of District personnel. He 14 shall appoint or assign persons to positions formerly occupied, ex officio, by the Commissioner of the District of Colum16 bia or by the Assistant to the Commissioner and shall have

power to remove such persons from such positions. The offi

cers and employees of each agency with respect to which 19 legislative power is delegated by this Act and which, im20 mediately prior to the effective date of this section, was not 21 subject to the administrative control of the Commissioner of 22 the District, shall continue to be appointed and removed 23 in accordance with applicable laws until such time as such 24 laws may be superseded by legislation passed by the Council 25 establishing a permanent District government merit system or systems pursuant to section 402 (4).

1 (4) He shall administer the personnel functions of the 2 District covering employees of all District departments, 3 boards, commissions, offices, and agencies, except as other4 wise provided by this Act. Personnel legislation enacted by 5 Congress, prior to or after the effective date of this section, 6 including, without limitation, legislation relating to appoint7 ments, promotions, discipline, separations, pay, unemploy8 ment compensation, health, disability and death benefits, 9 leave, retirement, insurance, and veterans' preference, appli10 cable to employees of the District government, as set forth 11 in section 1002 (c), shall continue to be applicable until such 12 time as the Council shall, pursuant to this section, provide 13 equal or equivalent coverage under a District government 14 merit system or systems. The District government merit 15 system or systems shall be established by legislation of the 16 Council. The system or systems may provide for continued 17 participation in all or part of the Federal Civil Service sys18 tem and shall provide for persons employed by the District 19 government immediately preceding the effective date of such 20 system or systems personnel benefits, including but not lim21 ited to pay, tenure, leave, residence, retirement, health and 22 life insurance, and employee disability and death benefits, all 23 at least equal to those provided by legislation enacted by 24 Congress, or regulation adopted pursuant thereto, and appli25 cable to such officers and employees immediately prior to the

1 effective date of the system or systems established pursuant to 2 this Act. The District government merit system or systems

3 shall take effect not earlier than one year nor later than five

4

years after the effective date of this section.

(5) He shall, through the heads of administrative 6 boards, offices, and agencies, supervise and direct the activi7 ties of such boards, offices, and agencies.

8 (6) He shall, at the end of each fiscal year, prepare

9

reports for such year of (a) the finances of the District, and 10 (b) the administrative activities of the executive office of the 11 Mayor and the executive departments of the District. He 12 shall submit such reports to the Council within ninety days 13 after the close of the fiscal year.

(7) He shall keep the Council advised of the financial 15 condition and future needs of the District and make such 16 recommendations to the Council as may seem to him de17 sirable.

(8) He may submit drafts of acts to the Council.

(9) He shall perform such other duties as the Council, 20 consistent with the provisions of this Act, may direct. (10) He may delegate any of his functions (other than 22 the function of approving or disapproving acts passed by the 23 Council or the function of approving contracts between the 24 District and the Federal Government under section 901) to any officer, employee, or agency of the executive office of
