power to remove such persons from such positions. The offi

cers and employees of each agency with respect to which 5 legislative power is delegated by this Act and which, im6 mediately prior to the effective date of this section, was not

subject to the administrative control of the Commissioner of 8 the District, shall continue to be appointed and removed 9 in accordance with applicable laws until such time as such 10 laws may be superseded by legislation passed by the Council 11 establishing a permanent District government merit system. or systems pursuant to section 402 (4) .

(4) He shall administer the personnel functions of the 14 District covering employees of all District departments,

15

boards, commissions, offices, and agencies, except as other16 wise provided by this Act. Personnel legislation enacted by

17

Congress, prior to or after the effective date of this section, 18 including, without limitation, legislation relating to appoint

ments, promotions, discipline, separations, pay, unemploy

ment compensation, health, disability, and death benefits,

leave, retirement, insurance, and veterans' preference, applicable to employees of the District government, as set forth

in section 1002 (c), shall continue to be applicable until such time as the Council shall, pursuant to this section, provide

equal or equivalent coverage under a District government

1 merit system or systems. The District government merit 2 system or systems shall be established by legislation of the 3 Council. The system or systems may provide for continued 4 participation in all or part of the Federal Civil Service Sys5 tem and shall provide for persons employed by the District 6 government immediately preceding the effective date of such

system or systems personnel benefits, including but not lim8 ited to pay, tenure, leave, residence, retirement, health and 9 life insurance, and employee disability and death benefits, all 10 at least equal to those provided by legislation enacted by 11 Congress, or regulation adopted pursuant thereto, and appli12 cable to such officers and employees immediately prior to the 13 effective date of the system or systems established pursuant to 14 this Act. The District government merit system or systems 15 shall take effect not earlier than one year nor later than five years after the effective date of this section.

(5) He shall, through the heads of administrative boards, offices, and agencies, supervise and direct the activi19 ties of such boards, offices, and agencies.

(6) He shall, at the end of each fiscal year, prepare reports for such year of (a) the finances of the District, and 22 (b) the administrative activities of the executive office of the 23 Mayor and the executive departments of the District. He

shall submit such reports to the Council within ninety days after the close of the fiscal year.

(7) He shall keep the Council advised of the financial

2 condition and future needs of the District and make such

3 recommendations to the Council as may seem to him 4 desirable.

(8) He may submit drafts of acts to the Council.

(9) He shall perform such other duties as the Council, 7 consistent with the provisions of this Act, may direct.

8 (10) He may delegate any of his functions (other than 9 the function of approving or disapproving acts passed by the 10 Council or the function of approving contracts between the 11 District and the Federal Government under section 901) 12 to any officer, employee, or agency of the executive office of 13 the Mayor, or to any director of an executive department 14 who may, with the approval of the Mayor, make a further 15 delegation of all or a part of such functions to subordinates 16 under his jurisdictions.

(11) There shall be a City Administrator, who shall be appointed by the Mayor and who may be removed by the

Mayor. The City Administrator shall be the principal man

agerial aide to the Mayor, and he shall perform such duties

as may be assigned to him by the Mayor.

(12) The Mayor or the Council may propose to the

executive or legislative branches of the United States Gov

ernment legislation or other action dealing with any subject

1 not falling within the authority of the District government,

2 as defined in this Act.

(13) As custodian the Mayor shall use and authenticate

4 the corporate seal of the District in accordance with law.

5

(14) He shall have the right, under the rules, to be

6 adopted by the Council, to be heard by the Council or any

7 of its committees.

(15) He is authorized to issue and enforce such admin9 istrative orders, not inconsistent with any Act of the Con

10

gress or any act of the Council or of the qualified voters of 11 the District of Columbia, as are necessary to carry out his 12 functions and duties.

TITLE V-THE DISTRICT BUDGET

FISCAL YEAR

SEC. 501. The fiscal year of the District of Columbia 16 shall begin on the 1st day of July and shall end on the 17 30th day of June of the succeeding calendar year. Such 18 fiscal year shall also constitute the budget and accounting

BUDGETARY DETAILS FIXED BY DISTRICT COUNCIL

SEC. 502. (a) The Mayor shall prepare and submit,

not later than April 1, to the District Council, in such form

as the Council shall approve, the annual budget estimates

of the District and the budget message.

1 (b) The Mayor shall, in consultation with the Council, 2 take whatever action may be necessary to achieve, insofar 3 as is possible, (1) consistency in accounting and budget 4 classifications, (2) synchronization between accounting and 5 budget classifications and organizational structure, and (3) 6 support of the budget justifications by information on per7 formance and program costs as shown by the accounts.

9 SEC. 503. The Council shall by act adopt a budget for 10 each fiscal year not later than May 15, except that the 11 Council may, by resolution, extend the period for its adop12 tion. The effective date of the budget shall be July 1 of the same calendar year.

FIVE-YEAR CAPITAL PROGRAM

SEC. 504. (a) Prior to the adoption of the annual 16 budget, the Council shall adopt a five-year capital program 17 and a capital budget.

18 (b) The Mayor shall prepare the five-year capital pro19 gram and shall submit said program and the capital budget

20 message to the Council, not later than February 1.

(c) The capital program shall include:

(1) a clear general summary of its contents;

(2) a list of all capital improvements which are

proposed to be undertaken during the five fiscal years
