1 by this Act, including, without limitation, legislation to 2 amend or repeal any law in force in the District prior to or 3 after enactment of this Act and any act passed by the 4 Council or by the qualified voters of the District of Columbia. 5 (g) Except as limited by subsection (h) of this section, 6 upon the effctive date of this part, jurisdiction over the 7 municipal courts of the District of Columbia shall vest with 8 the District Council in all matters (other than the appoint9 ment of judges) pertaining to the organization and composi10 tion of such courts, and to the qualification, tenure, and compensation of the judges thereof: Provided, That the Coun12 cil shall not transfer or modify any function performed by 13 the United States marshal or the United States attorney for 14 the District on the effective date of this part. to positions as judges of the municipal courts of the District

of Columbia shall be made by the President of the United 17 States, with the advice and consent of the Senate. Nothing 18 in this Act shall be construed to change the tenure of any persons occupying positions as judges of the municipal courts 20 of the District of Columbia on the effective date of this part,

except that their compensation may be increased.

(h) On or after the effective date of this part, any person appointed to serve as judge of one of the municipal courts of the District of Columbia shall not (1) be appointed to

serve for a term of less than ten years, (2) serve on the

1 court past the year that the seventieth anniversary of his 2 birth shall occur, or (3) receive as compensation for such 3 service an amount less than the amount payable to an asso4 ciate judge of the Superior Court of the District of Columbia 5 on the effective date of this part.

6 (i) Nothing in this section or elsewhere in this Act 7 shall be construed as authorizing the District Council to cur8 tail the jurisdiction, established by enactment of the Con9 gress of the United States, of the United States District 10 Court for the District of Columbia or any other United 11 States court other than the municipal courts of the District.

PART 3-ORGANIZATION AND PROCEDURE OF THE

DISTRICT COUNCIL

THE CHAIRMAN

SEC. 331. The Chairman of the District Council shall be 16 the presiding officer of the Council. The District Council shall 17 elect from among its members a Vice Chairman, who shall 18 preside in the absence of the Chairman. When the Mayor 19 is absent or unable to act, or when the office is vacant, the

20 Chairman shall act in his stead.

SEC. 332. (a) The Council shall appoint a secretary as

24 its chief administrative officer and such assistants and clerical

25 personnel as may be necessary. Notiwthstanding any other

1 provision of this Act, the compensation and other terms of

2 employment of such secretary, assistants, and clerical person

3 nel shall be prescribed by the Council.

(b) The secretary shall (1) keep a record of the pro5 ceedings of the Council, (2) keep a record showing the 6 text of all acts introduced and the ayes and noes of each vote. 7 (3) authenticate by his signature and record in full in a 8 continuing record kept for that purpose all acts passed by the 9 Council and by the qualified voters of the District of Colum10 bia, including the date and time that each such act takes 11 effect, and (4) perform such other duties as the Council may from time to time prescribe.

(c) The records required by subsection (b) shall be 14 available for public inspection during normal business hours 15 and copies of the records shall be made available for pur16 chase under such conditions and upon the payment of such 17 fees as the Council shall deem appropriate.

MEETINGS

SEC. 333. (a) A majority of the District Council shall 20 constitute a quorum for the lawful convening of any meet21 ing of the Council and for the transaction of business of 22 the Council.

(b) The first meeting of the Council after this part 24 takes effect shall be called by the Chairman of the District

25 Council elected in accordance with this Act. Following each

1 such election, but not later than December 15 of the year of 2 the election, the secretary of the Council shall call the first 3 meeting of the members of the Council elected in such elec4 tion for a date not later than January 7 of the next year. 5 (c) The Council shall provide for the time and place 6 of its regular meetings. The Council shall hold at least one 7 regular meeting in each calendar week except that during 8 July and August it shall hold at least two regular meetings 9 in each month. Special meetings may be called, upon the 10 giving of adequate notice, by the Mayor, the Chairman, or any three members of the Council.

(d) Meetings of the Council shall be open to the public 13 and shall be held at reasonable hours and at such places as 14 may be necessary to accommodate a reasonable number of

spectators. The Council shall not exclude the public from any 16 of its meetings unless the national security is involved. Any 17 citizen shall have the right to petition and be heard by the 18 Council at any of its meetings, within reasonable limits as 19 set by the Council.

COMMITTEES

SEC. 334. The Council Chairman, with the advice and 22 consent of the Council, shall determine the standing and 23 special committees which may be expedient for the conduct 24 of the Council's business. The Chairman shall appoint

25 members to such committees. All committee meetings shall

1 be open to the public except when ordered closed by the

2 committee chairman, with the prior approval of a majority 3 of the members of the committee.

5 SEC. 335. (a) The Council, to discharge the powers and

6 duties imposed herein, shall pass acts and adopt resolutions,

upon a vote of a majority of the members of the Council

present and voting, unless otherwise provided herein. The 9 Council shall use acts for all legislative purposes. Resolutions 10 shall be used to express simple determinations, decisions, or 11 directions of the Council of a special or temporary character. 12 (b) (1) The enacting clause of all acts passed by the 13 Council shall be, "Be it enacted by the Council of the District of Columbia:".

(2) The resolving clause of all resolutions passed by the 16 Council shall be, "The Council of the District of Columbia

18 (c) A special election may be called by resolution of the

Council to present for referendum vote of the people any

proposition upon which the Council desires to take such action.

PASSAGE OF ACTS

SEC. 336. The Council shall not pass any act before

the thirteenth day following the day on which it is intro

25 duced. Subject to the other limitations of this Act, this
