general public, an officer of the rank of Lieutenant or higher may interrupt the duty of any member of lesser rank by relieving him from duty and placing him in an annual leave status for the remainder of his duty assignment. When a member is so relieved from duty, the officer relieving such member shall immediately submit a report to the Chief, who, if he approves the same, will forthwith make appropriate recommendations to the Superintendent.

Section 12. Any member found to be intoxicated while on duty, or off duty while in uniform, shall be taken forthwith before the officer then in charge of the police force. The officer in charge shall, upon finding that there is reasonable cause to believe that such member was intoxicated while on duty, place such member in an annual leave status for the remainder of his duty assignment, and shall take possession of his badge and service revolver. A full report of the incident shall be submitted to the Chief who shall report the matter to the Superintendent with recommendations for appropriate disciplinary action.

Section 13. Since summary suspensions of park police personnel are prohibited by the rules of the United States Civil Service Commission, members of the police force who are unfit for duty for any reason may be placed on annual leave. Neither officers nor subordinate supervisors have authority to relieve a member of the park police force from the performance of his duty except under circumstances as is provided in Sections 11 and 12 above. In all other cases the Superintendent, or one acting in his behalf, must authorize the placing of park police personnel on annual leave in disciplinary matters in accordance with the rules and procedures of the United States Civil Service Commission.

Section 14. Members of the police force shall not communicate, verbally or in writing, directly or indirectly, in any manner or form, any information which may enable persons guilty of criminal acts or other violations to escape arrests or punishment, or dispose of or secrete any money or other valuables the proceeds of a crime, or to destroy any evidence which would tend to establish guilt.

Section 15. Members of the police force shall not, except by permission of a superior officer, communicate to anyone but a member of the force any information concerning cases in hand, or re

specting orders he has received, or about his contemplated movements in connection with such

cases.

Section 16. Members of the police force shall not, directly or indirectly, seek publicity through the public press, or give any information to any member of the press without the permission of the Chief, or his representative designated by him to approve such release of information.

Section 17. Members of the police force shall not serve civil processes, nor shall they render assistance in civil cases. They shall, however, prevent breaches of the peace and quell disturbances growing out of such matters and protect United States Marshals in the discharge of their duties.

Section 18. Members of the police force shall not wear their badges exposed when off active duty, but shall carry them in such a manner as to permit ready display when necessary. They shall carry their badges and service revolvers at all times while off duty and in civilian clothes, any place in the District of Columbia, or in the states of Maryland or Virginia in areas under the jurisdiction of the National Capital Parks. This requirement does not apply to their residences. When off duty and not in full uniform, members of the force shall wear their service revolvers in such a manner as to conceal them from view.

Section 19. Members of the police force shall not testify in civil cases unless legally summoned. Section 20. Members of the police force shall not testify before any ABC Board, for or against or in behalf of any individual who may be applying for license to sell or dispense liquor or intoxicating beverages, without the prior approval of the Superintendent.

Section 21. Members of the police force shall not interfere with the cases of other members except by consent of such other member or their commanding officer.

Section 22. Members of the police force shall not be connected with any military body other than the Army, Air Force, Navy, Marine or Coast Guard Reserve Corps, or National Guard.

Section 23. No member of the police force while on active duty shall engage in or take any part in any discussions or arguments involving political, religious, or racial aspects with other members or employees or persons outside the police department.

Section 24. Members of the police force shall avoid political or religious discussions detrimental to discipline.

Section 25. Members of the police force shall not engage in any line of business where such action will in any manner, directly or indirectly, interfere with the proper and efficient performance of police duty.

Section 26. Members of the police force shall not perform at any time for wage, salary, fee, gift, or other compensation, any work or service of any character for any person, firm, or corporation other than that required by their official position in the police force where such work will, directly or indirectly, interfere with the proper and efficient performance of police duty.

Section 27. Members of the police force shall not use their revolvers except:

(a) To defend themselves from death or serious injury.

(b) To defend another person unlawfully attacked from death or serious injury.

(c) To effect the arrest or to prevent the escape, when every other means for effecting the arrest have been exhausted, of a convicted felon or of a person who has committed a felony in the policeman's presence or whose guilt is clear, or when a felony has been committed and the policeman has reasonable grounds to believe that the person fleeing from the scene of the crime committed the felony.

(d) To kill a dangerous animal, or to kill an animal so badly injured that humanity requires its removal from further suffering.

Members of the police force shall, when they use their revolvers, batons, or blackjacks, make a complete report of same to the Chief who shall have an investigation made of the case, and when necessary, forward the report to the Superintendent with recommendations.

A policeman who fires a revolver in a public place takes many risks and must do so in such a manner as will not jeopardize the lives of innocent persons.

Section 28. Members of the police force shall be punctual in reporting for duty at the time and place designated by their superior officers.

Section 29. Members of the police force below the rank of Captain shall be individually responsible for personally checking with headquarters

each day for their hours and assignments for the following day.

Section 30. Members of the police force in a supervisory capacity and regularly assigned to duty during regular daily hours, or to duty involving changes of hours according to a regular schedule, shall work according to plan and schedule until notified of changes at the direction of proper authority. The same shall apply to members of the force of lesser rank who have special duties assigned during regular hours or according to a regular schedule.

Section 31. Members of the police force having determined their duty hours and assignments for the following day shall not be held accountable for failure to report at a different time and for a different assignment if such change occurs after they had ascertained their hours of duty and assignments should the headquarters fail to notify them of such change. Once a member of the force has ascertained his hours of duty and place of assignment, it will be the responsibility of the headquarters to advise him of any change which might occur thereafter.

Section 32. Members of the police force off-duty and scheduled for duty on the following day shall be responsible for ascertaining their hours of duty and place of assignment when next due for duty between the hours of 3 and 10 p. m. on the day preceding that on which they are scheduled for duty.

Section 33. Members of the police force shall be subject to and shall comply with all applicable rules and regulations of the service insofar as they relate to the reporting of injuries occurring, illnesses which prevent the reporting for duty, illnesses which require abrupt termination of day's duty, and absence for illness which requires excuse.

Section 34. Members of the police force injured or taken ill in the performance of duty shall make the facts known to their immediate supervisor without delay, who shall take the necessary action as will best handle the incident in the interest of the department and the welfare of the employee. Written reports of such incidents are mandatory.

Section 35. Members of the police force who become ill or who are injured while on duty and unable to finish their tour of duty shall apply to the Police Clinic for treatment or hospitalization if found necessary.

Section 36. Members of the police force taken ill or injured while on or off duty shall communicate such facts to their police doctor at the very earliest time. If such illness or injury is incurred during clinic hours, it will be the duty of such member to report to the clinic immediately.

Section 37. No member of the police force shall on account of illness or injury leave his beat or post or other duty assignment without first making every effort possible to communicate with his supervisor or the headquarters.

Section 38. Members of the police force who become ill or injured while off-duty and are unable to report for duty shall communicate with the headquarters at least one hour prior to the time at which scheduled to report. The failure of any messenger to deliver the information will not relieve the member of the responsibility.

Section 39. Any member of the police force who feigns or simulates illness or disability in order to evade the performance of duty, or whose illness is caused by carelessness, improper conduct, excessive indulgence in drink, or through bad habits will be subject to severe disciplinary action.

Section 40. Members of the police force are always on duty, although periodically relieved from routine performance; they are always subject to orders from the proper authorities and to call from citizens. The fact that they may be technically off duty shall not be held as relieving them from the responsibility of taking proper police action in any matter coming to their attention requiring such action.

Section 41. When a member of the police force changes his residence or telephone number, he shall report such change to the commanding officer within 24 hours after making such change. Every member of the force shall be required to have a telephone, listed in his name, at his residence address.

Section 42. Members of the police force shall at all times maintain decorum and command of temper; shall be patient and discreet, and shall not use harsh, violent, profane or insolent language, and shall be courteous and considerate under all circumstances.

Section 43. When members of the police force sever their connections, they shall deliver to their commanding officer their revolver, badge, and cap plates at the expiration of their last active tour

of duty. They shall also return to the officer in charge of clothing and equipment all Federal Government property previously issued them. All articles of uniform must be returned in a clean and sanitary condition.

Section 44. A member of the police force may report another member for violation of any rule or regulation of the United States Park Police to their superior officer, which officer will investigate the complaint, and if violation is substantiated, he will then report such complaint through channels to the Chief.

Section 45. Members of the police force shall familiarize themselves with the statutes, laws and regulations in force in the District of Columbia, Maryland and Virginia, particularly those pertaining to and governing the National Capital Parks, and failure to do so, or to take the necessary action respecting violations of such statutes, laws, and regulations coming to their attention, will be deemed neglect of duty.

Section 46. Members of the police force shall not belong to any political club or organization or be a delegate or representative to any political or partisan convention or take an active part in behalf of any candidate for political office, except as provided by act of Congress.

Section 47. Any members of the police force before soliciting or making contributions in money or other thing, directly or indirectly, to any person, committee, or association for political purposes, or engaging in any plan or scheme for raising money for any such organization or individual, shall familiarize himself with the provisions of the Hatch Act (5 U. S. C., 1946 ed., Supp. III, secs. 118i-118n; 18 U. S. C., 1946 ed. Supp. III, secs. 595, 598, 601, 604, 605, 609, 611).

Section 48. Superior officers shall not receive presents from subordinates nor shall subscriptions be solicited or made for presents by members of the police force to other members without the consent and approval of the Chief.

Section 49. Members of the police force shall make full reports to the headquarters of all crimes, accidents and injuries to persons, damage to Government or other property, persons found sick in the public parks or elsewhere, missing persons or any other type of report not specifically set forth above or required by this manual but which is required in any general or memorandum order

issued by the police force or any matter coming to their attention. Any report form adopted for use by the United States Park Police and on which instructions appear, shall constitute an order of the police force. All the reports required by this section shall be complete and in detail and submitted promptly.

Section 50. In cases where arrests for the commission of crimes are made on the spot, without previous report having been made, a report will be filed in the same manner and form as though no arrest had been made and shall include the fact that the case has been cleared by arrest. Such reports to be complete in detail and made promptly.

Section 51. Personal Injuries on Government Property. In all cases involving falls of persons on Government property or any other case resulting in personal injury to persons on Government property, the officer witnessing or hearing of such an accident shall, if a witness, immediately mark the point of the fall or incident or if he hears of the accident, shall obtain the name and address of the injured party and determine from the injured party, if possible, all the circumstances, including the precise location of the fall or incident, and forthwith mark the same, and shall determine the names and address of all witnesses who have information regarding the circumstances of the fall. As soon as possible after determining the above facts, the officer shall contact the headquarters and request a photographer to take pictures and measurements of the place where the fall occurred.

Section 52. Members of the police force having knowledge of an injury incurred on their beat and as a result of possible negligence on the part of the Government shall immediately proceed to investigate and report in minute detail all facts and circumstances causing such injury. In all such cases adequate photographs shall be taken as well as measurements and any other pertinent facts recorded which would be of assistance to the Government in determining responsibility.

Section 53. In all cases of accident or illness requiring an officer's attention, members of the police force shall render prompt assistance, taking such action as may be necessary in the premises. Section 54. Damage to Government property. All accidents involving damage to Government property or involving Government vehicles be

longing to the National Capital Parks shall promptly be reported on forms provided, with full details, including names and addresses of wit

nesses.

Section 55. Members of the police force shall be vigilant in observing the condition of streets, roadways, sidewalks, foot paths, bridle paths or other areas under the jurisdiction of the National Capital Parks and immediately report any defects likely to cause damage or injury to persons or property. They shall, if necessary, take prompt action to barricade the same during the day, and to see that such places are properly lighted at night. Appropriate barricades may be obtained upon calling headquarters.

Section 56. Members of the police force in the performance of their duty and while on routine patrol shall be held responsible for frequently testing and inspecting the locks and other safeguards provided for the security of buildings, enclosures, and storage facilities located on their beats. They shall be held responsible for reporting doors, windows, gates, or locks found to be insecure or damaged. Members of the force finding doors to buildings open or broken in shall immediately report such condition to their immediate supervisor and request further directions. If such building or storage facility contains articles of value, the officer discovering same shall stand by and afford protection of such property until arrangements have been made and the building secured.

Section 57. Members of the police force, regardless of rank or assignment, shall be vigilant in noting physical defects or alterations in public spaces which would constitute a hazard, or potential hazard; such as, obstructions to public passageways, breaks in the pavement, foot paths and bridle paths. They shall also take cognizance of unscheduled excavations, openings, icy and slippery places which would be likely to imperil life or limb.

Section 58. Members of the police force observing such conditions shall take immediate steps to remedy such situations through their efforts if practicable; if not, then proper precautions should be taken to afford such hazards necessary light, barricades, or signs as a warning to the public. Members of the force shall be held responsible for reporting all such deficiencies.

Section 59. Members of the police force shall not allow any excavation on Government property or the construction of any building, stand, fence or structure of any kind without proper evidence of authorization: Provided, That employees of the National Capital Parks, while engaged in such construction or excavation as a part of the regular maintenance, shall not be interfered with.

Section 60. Members of the police force shall be vigilant at all times in observing, and shall report to the headquarters, any condition requiring repair or construction by the Maintenance or Construction and Repair Division.

Section 61. Members of the police force shall promptly report the existence of leaking or broken water pipes within the park system. Fountains overflowing or otherwise not properly functioning should be reported immediately.

Section 62. Any member of the police force who loses his badge or other equipment or insignia through carelessness in failing to properly secure or attach same, or who, having lost any part of his equipment, fails to report such fact promptly, in writing, to the Chief, shall be deemed guilty of neglect of duty.

Section 63. Members of the police force shall not intentionally come in contact with persons suffering from diphtheria, scarlet fever, smallpox or other contagious diseases, or with those in attendance on such persons, except by authorization of a member of the Board of Police and Fire Surgeons.

Section 64. When a member of the police force has come in direct contact with a patient having a contagious disease, or has been exposed to contagion, he shall at once notify his police doctor and comply with instruction.

Section 65. Members of the police force locating or knowing of persons suffering from malignant, infectious, or epidemical diseases, shall report same to the Health Department through the headquarters.

Section 66. Members of the police force shall not, by threat or recommendation, or in any other manner, directly or indirectly, use their office for the purpose of influencing the lawful business, profession, or occupation of any person or persons.

Section 67. When a member of the police force discovers a fire he shall sound an alarm of fire by

telephone to fire-alarm headquarters, or turn in an alarm from the nearest fire alarm box, whichever means is more readily available. He shall prevent interference with the firemen by pedestrians or traffic and make a report to the headquarters of all facts and circumstances. Reports of fires involving damage to Federal property (buildings) shall be filed on forms provided for that purpose. If the fire is of suspicious origin, he shall make a thorough investigation with a view of prosecution.

Section 68. Members of the police force on patrol duty shall, when they hear fire apparatus, immediately determine the location of the fire. If the fire is on their beat, they shall respond promptly and assist in directing or rerouting traffic and preventing interference with the firemen.

Section 69. Any member of the police force who finds a dead body or learns of a case where death has ensued without a physician having been in attendance shall immediately notify headquarters and receive instructions relative to further proceedings. The officer on the scene shall obtain all particulars, but shall not disturb or permit the disturbance of the body or surroundings, and shall allow no unauthorized person within the premises or near the point where the body is found until such time as the Homicide Squad or the coroner has arrived and taken charge. He shall not handle or permit the handling of weapons, or other objects on or near the person which might bear fingerprints. He shall maintain the possible crime scene in exactly the same condition as discovered by him. He shall carefully preserve all fingerprints, handprints, footprints, and tireprints. He shall take the names of persons who may have knowledge of the occurrence, and if necessary detain any individual whose statement might be needed in establishing any fact in connection with the case, and shall arrest any person against whom there exists a reasonable suspicion of guilt supported by facts, circumstances, or credible information, and shall make a complete report of all facts and details connected with the case.

Section 70. Whenever a member of the police force is called to the scene of a rape, robbery, serious assault, housebreaking, or other major crime, he shall take immediate steps to prevent any disturbance of the crime scene or visible or latent evidence such as fingerprints, footprints, bloodstains, documents, etc., pending arrival of
