In this part the following words and phrases, unless otherwise stated, shall be considered as having the meaning herein defined: (a) "Act" shall mean the Federal Alcohol Administration Act. (b) "Administration" shall mean the Federal Alcohol Administration. (c) "Administrator" shall mean the head of the Federal Alcohol Administration. (d) "Basic permit" shall mean a formal written authorization by the Administrator setting forth specifically therein the acts authorized and permitted. (e) "Permittee" shall mean any person holding a basic permit issued under the act. (f) "Respondent" shall mean any person holding a basic permit against which proceedings for revocation, suspension, or annulment have been instituted. (g) "Resale at wholesale" shall mean a sale to any trade buyer. BASIC PERMITS 1.20 When required-(a) Importers of distilled spirits, wine, and malt beverages. On and after November 23, 1935, no person, except pursuant to a basic permit issued under the Act by the Administrator, shall (1) Engage in the business of importing into the United States distilled spirits, wine, or malt beverages; or, (2) While so engaged, sell, offer or deliver for sale, contract to sell, or ship, in interstate or foreign commerce, directly or indirectly or through an affiliate, distilled spirits, wine, or malt beverages so imported. (b) Domestic producers, rectifiers, blenders, and warehousemen. On and after November 23, 1935, no person, except pursuant to a basic permit issued under the Act by the Administrator, shall (1) Engage in the business of distilling distilled spirits, producing wine, rectifying or blending distilled spirits or wine, or bottling, or warehousing and bottling, distilled spirits; or, (2) While so engaged, sell, offer or deliver for sale, contract to sell, or ship, in interstate or foreign commerce, directly or indirectly Page 2 |
