Memorandum for the Secretary of Commerce.

1. In response to a request dated June 16, from the Committee on Interstate and Foreign Commerce of the House of Representatives, the following report is submitted on H. R. 12967, granting certain lands to the city of Dunkirk of Chautauqua County, N. Y., for street purposes.

2. At the present time the city of Dunkirk is using a right of way around the point of land comprising Point Gratiot Lighthouse Reservation, but, due to erosion, it is considered advisable to cut a roadway from the eastern to the southeastern water lines which roadway will be 66 feet wide, 33 feet of which will be on Government property along the southerly boundary line of the reservation referred to, and then closing the present roadway around the bluff to vehicular traffic. The bureau considers that it would be advantageous to the Lighthouse Service to have the land transferred to the city of Dunkirk as proposed in H. R. 12967 and it is recommended that the matter be reported favorably by the department, if there is no objection. A description of the property proposed to be transferred is given in the bill.

REPORT

[To accompany H. R. 11136]

The Committee on Interstate and Foreign Commerce, to whom was referred the bill (H. R. 11136) authorizing the Florence Bridge Co., its successors and assigns, to construct, maintain, and operate a toll bridge across the Missouri River at Florence, Nebr., having considered the same, report thereon with a recommendation that it pass. The bill has the approval of the War Department, as shown by report on H. R. 10077, a similar bill by the letter attached.

The accompanying bill, H. R. 10077, Seventy-first Congress, second session, proposes to authorize the Florence Bridge Co. to construct, maintain, and operate a bridge across the Missouri River at or near Florence, Nebr.

Attention is invited to the favorable report of the department, January 2, 1930, on H. R. 7820, Seventy-first Congress, second session, to authorize the construction of a bridge at the same locality by the city of Omaha, Nebr., or Douglas County, Nebr., or the city of Council Bluffs, Iowa, or Pottawattamie County, Iowa, or any two or more thereof cooperating.

No objection is interposed to the passage of the accompanying bill, if amended as indicated in red thereon, with the understanding that but one bridge is actually to be constructed at the locality in question.

DEAR MR. PARKER: Careful consideration has been given to the bill, H. R. 10077, transmitted with your letter of February 20 with request for a report thereon and such views relative thereto as the department might desire to communicate.

This bill would authorize the Florence Bridge Co., its successors and assigns, to construct, maintain, and operate a toll bridge and approaches thereto, across the Missouri River, at or near Florence, State of Nebraska. The proposed bridge would be an interstate bridge between Nebraska and Iowa. The bill follows the usual form for a private interstate toll bridge.

The location of the bridge would be in the vicinity of the north corporate limits of the city of Omaha, Nebr. The only highway bridge which now crosses the Missouri River at Omaha is a private toll bridge which the city has been endeavoring for several years to acquire at a reasonable price but so far has been unable to do so. There is quite a local controversy concerning the matter, for which reason it is believed that it would be very inadvisable at this time to authorize the construction of a new private toll bridge in such close proximity to the existing one. The department, therefore, would recommend against favorable action on the bill.

[To accompany H. R. 12844]

The Committee on Interstate and Foreign Commerce, to whom was referred the bill (H. R. 12844) granting the consent of Congress to the State of Montana, the counties of Roosevelt, Richland, and McCone, or any of them, to construct, maintain, and operate a free highway bridge across the Missouri River at or near Poplar, Mont., having considered and amended the same, report thereon with a recommendation that it pass.

Amend the bill as follows:

After line 10 add the following as a new section:

SEC. 2. The right to alter, amend, or repeal this act is hereby expressly reserved. The bill has the approval of the War and Agriculture Departments, as will appear by the letters attached.

So far as the interests committed to this department are concerned, I know of no objection to the favorable consideration of the accompanying bill (H. R. 12844, 71st Cong., 2d sess.) granting the consent of Congress to the State of Montana, the counties of Roosevelt, Richland, and McCone, or any of them, to construct a free highway bridge across the Missouri River at or near Poplar, Mont., if amended as indicated in red thereon.
