approaches thereto herein authorized for its tracks until the said company shall have paid to the collector of taxes of the District of Columbia a sum equal to one-fourth of the cost of said viaduct and approaches, which sum shall be deposited to the credit of the District of Columbia.

SEC. 3. That for the purpose of carrying into effect the foregoing provisions, the sum of [$275,000] $500,000 is hereby authorized to be appropriated, payable in like manner as other appropriations for the expenses of the government of the District of Columbia, and the said commissioners are authorized to expend such sum as may be necessary for personal [services and] services, engineering and incidental [expenses.] expenses, including cost of relocating sewers and water mains. The said commissioners are further authorized to acquire, out of the appropriation herein authorized, the necessary land [or any portion of same within the limits of Michigan Avenue as shown on the recorded highway plan,] to carry out the provisions of this act, by purchase at such price or prices as in their judgment they may deem reasonable and fair, or, in the discretion of the commissioners, by condemnation in accordance with [the provisions of subchapter 1 of] Chapter XV of the Code of Law for the District of Columbia [under a proceeding or proceedings in rem instituted in the Supreme Court of the District of Columbia: Provided, however, That of the entire amount found to be due and awarded by the jury as damages for, and in respect of, the land to be condemned to carry the provisions of this Act into effect, plus the costs and expenses of the proceeding or proceedings taken pursuant hereto, not less than one-half thereof shall be assessed by the jury as benefits, the amounts collected as benefits to be covered into the Treasury of the United States, to the credit of the District of Columbia] as amended.

SEC. 4. That from and after the completion of the said viaduct and approaches the highway grade crossing over the tracks and the right of way of the said Baltimore and Ohio Railroad Company at Michigan Avenue in the District of Columbia shall be forever closed against further traffic of any kind.

REFUND BACK SALARIES DUE COLORED DIRECTORS OF THE SCHOOL SYSTEM OF THE DISTRICT OF COLUMBIA

Mr. PALMER, from the Committee on the District of Columbia, submitted the following

REPORT

[To accompany H. R. 12158]

The Committee on the District of Columbia, to whom was referred the bill (H. R. 12158) authorizing the Secretary of the Treasury to refund to the so-called assistant directors in the public schools of the District of Columbia, divisions 10-13, all that portion of their salaries erroneously and illegally deducted and withheld under the provisions of the act of June 20, 1906, having considered the same, report back to the House with the recommendation that the legislation do pass.

The purpose of this bill is to rectify an injustice inadvertently done to the colored directors of the public-school system of the District of Columbia, through the act of Congress of June 20, 1906, which provided for salary schedules for teachers and school officers of the Board of Education in the District of Columbia. That act designated the colored directors of the public-school system as "assistant directors," but it was not intended that they should not receive the same salary as the directors in the white schools who perform identically the same service. When the bill came out of conference and passed, however, the assistant directors' salaries were lowered, it is believed through oversight.

There was an act passed by Congress on July 1, 1924, equalizing salaries of school teachers, which made no differentiation between the same work done by the white and colored schools, but up to this time no action or movement has been made to take care of the back salaries due these assistant directors, under the act of June 20, 1906. This bill is simply to equalize the difference in salaries between June 20, 1906, and July 1, 1924, and the committee feels that the measure is fair, reasonable, and justified.

Appended hereto is the claim of each individual named in the bill, showing the method of computation of the amount claimed to be due.

CLAIM OF E. F. G. MERRITT, ASSISTANT DIRECTOR" PRIMARY INSTRUCTION

The act of June 20, 1906, entitled "An act to fix and regulate the salaries of teachers, school officers, and other employees of the Board of Education of the District of Columbia," provided a minimum salary of $1,800 with a longevity increment of $50 for five years, and a maximum salary of $2,050 for the director of primary instruction.

The same act provided a minimum salary of $1,400, with a longevity increment of $50 for five years, and a maximum salary of $1,600 for the so-called "assistant director."

The act of June 20, 1906, entitled "An act to fix and regulate the salaries of teachers, school officers, and other employees of the Board of Education of the District of Columbia," provided a minimum salary of $1,500, with a longevity increment of $100 for five years, and a maximum salary of $2,000, for the director of physical culture.

The same act provided a minimum salary of $1,300, with a longevity increment of $50 for five years, and a maximum salary of $1,550 for the so-called assistant director of physical culture.

The act of June 20, 1906, entitled "An act to fix and regulate the salaries of teachers, school officers, and other employees of the Board of Education of the District of Columbia,' provided a minimum slary of $2,200, with a longevity increment of $100 for five years, and a maximum salary of $2,700 for the supervisor of manual training.

The same act provided a minimum salary of $1,300, with a longevity increment of $50 for five years, for the so-called assistant supervisor of manual training.
